regarding my last reblog, I want to state my own stance for anyone who might need to hear this, (because victims/survivors cope differently) while also affirming that the original message is an important one.

Based on my experience and education in the field, gihun having the card in his mouth can absolutely constitute sexual assault, or it can constitute non-sexual assault.

The canon does not provide enough facts for us to say conclusively whether or not the card being put in gihuns mouth was sexual assault. Assault, we can safely say yes to that. It is also 100000% valid to interpret it as sexual assault.

The most important source would be Gihun, simple as that. If he felt it was sexual assault, then it was. We dont know how he felt, but it is 1000% valid to hc that that is the way he feels. And when we consider the academic literature on what defines sexual assault, yes, it can constitute sexual assault.

Honestly I dont really care what the legal definitions have to say about it because the justice system sucks and invalidates victims/survivors as we all know. The legal definition is meant to determine whether or not charges can be made against the perpetrator, and then more aspects have to be proven in court "beyond a reasonable doubt" (a very high threshold) for the sexual assault to be legally recognized. This means most sexual assault cases do not end in a conviction which is bullshit.

Anyway, legally, we would have to be able to prove that Inho had the intention to sexually assault gihun in this case. We dont know, so you can choose to believe either way. Honestly, I hate this aspect of the legal process, because it is extremely difficult to prove this in court. In this specific fictional context, for this conversation, it is sliiightly relevant to help us understand different interpretations from people who have experienced sexual assault -- im only talking about those. Some people dont believe inho had sexual intentions with gihun, and thats also a valid interpretation. Its still assault, mind you lol, so inho's intention doesnt make it any more or less of a violent act.

I hope this can be read as I intend it, which is an effort to accommodate survivors/victims who may prefer to interpret that scene differently.

There’s an overwhelming propensity online these days to say “SA” or “sexual assault” in place of “rape”, and because of that a lot of people conflate the two and fail to immediately recognize other forms for SA. I’ve seen people dog piling on survivors or LITERAL LEGALLY DEFINED sexual assault, telling them they weren’t SA’d because they weren’t raped. I get it, it’s an uncomfortable word to hear, but when we replace it with something gentler, idk, we are blurring the definitions of both terms. Sanitizing words to accommodate censorship or bow to algorithms can literally change the meanings of the words, that’s just how language works, a word or phrase means what the majority of people think it means. With rape and SA were losing the distinction and kind of… changing what we see as sexual assault as a consequence of that? And that’s bad.

No Ann youre so right, i totally agree. I honestly got fucking sick as i typed out “SA”, i have avoided using that acronym for so long because i have survived this kind of shit and i know how watering it down makes it more dangerous for victims.

My point of using it was to get it across to the people who use that word willy nilly and still misuse it, Gihun’s trauma being dismissed as a case in point.
