Fender has shot itself in the balls and is trying to come back from that by suing more people
I'm sure if you're anywhere near guitar youtube you've seen a fuckton of videos about the situation, but in case you haven't here's what I know: Fender sued an Aliexpress company operating out of China (who's name seems to change in every article I look at) in Germany for the manufacturing of their stratocaster copies. As the lawsuit was in Germany and the company operated out of China, for several reasons they didn't show up to court, leading to fender winning the case by default.
Since this court case, fender has been sending cease and desist letters to many different companies making anything that looks remotely like a strat, using that case as a basis for copyright infringement.
This, as is evident, is a dick move. People have been manufacturing strat copies since strats were being made in the first place, with strat copies becoming probably the most common guitar made by many companies, with fender's rival gibson even making a few. To my understanding, fender let the original copyright for the strat body shape lapse YEARS ago, and with previous decisions on guitar body shapes labeling shapes like the les paul being generic, the decision to enforce copyright on the stratocaster has been seen by many as a bad move.
More recently, fender has sent a cease and desist letter to PRS guitars over their silver sky line, a line that has been in production since 2018. this is a stupid move for several reasons, first and foremost being that since PRS is considered the 3rd best selling guitar brand (according to wikipedia at least, I'm lazy, if you want quality look up videos on this) and thus can afford to fight a long legal battle better than the small companies fender had been going after previously. Even better than this, PRS has previously won a guitar body copyright lawsuit against fender's competitor, Gibson. so they both have the means and experience to fight this, meaning that if PRS wins, fender could lose copyright claims to its stratocaster line and potentially more shapes like the telecaster and jazzmaster.
again, look up videos if you want more info, but I for one am excited to see the downfall of one of the biggest guitar companies in the world potentially. if they go bankrupt from this I'm popping champagne and hoping gibson's next but that's just me
again, just speculation and opinion here, but I suspect they're trying to do this now because profits are way down for them. during covid, they saw a boom in profits due to people both being able to afford their products and having the free time to learn guitar. Those profits since then have been steadily declining, and in addition with the prices of everything raising, nobody can afford $400+ guitars anymore. This leads to people leaning towards cheaper guitars if they want one and "missed profits" for fender. In creating a lawsuit on a chinese company in germany, they raised the chances that they'd win the case, leading to the outcome we see now of fender using copyright laws to stop manufacturing of all stratocaster copies. because of this, fender believes that a person wanting a stratocaster would come to THEM FIRST, increasing profits. However, the backlash from the guitar community has proven that this method won't bring in the profits they hope, and going after companies like PRS would lead to a lot more bullshit that may set up dominoes for the entire company's collapse.
anyway yeah. do your own research, I'm too much of an anticapitalist to present this story with any sort of unbiased perspective
