The main petitioner in this whole thing is Abhijit Iyer Mitra (notorious transphobe, sexist, BJP supporter, and believer in Hindu supremacy). Most of the people who filed the petition are staunch BJP supporters, and they filed the PIL to enable same sex marriage under the Hindu Marriage Act. This essentially means that only people who belong to the Hindu religion will be granted the ability to same sex marriage.Â
As a queer person from a religious minority in this country, this looks like pinkwashing to me, and I am concerned as to what this means for people like me who are not cis, not Hindu, and non upper caste, especially given how politics in this country has progressed over the past few years.Â
I support same-sex marriage in India and the fight that we are all fighting, but this just…isn’t it. This PIL that the Delhi High Court has ruled against would not have been a win for anyone except Hindu people from queer communities. I, for one, would be very glad to have this petition quashed and have a larger more intersectional group of queer people fight this battle.Â
Edit: This petition was filed and heard in the Delhi High Court within the past few days, I’m unsure of when it was filed. This case will appear before the Delhi HC again on Oct 21. It is the news of this PIL that has started the #YesHomoVivah trend on Twitter.
I do also want to stress that it is incredibly important to counter ALL the regressive bullshit that the judges in the Delhi HC said as grounds to deny same sex marriage! We must continue to fight for the rights of ALL queer people in this country.
