I’m very sorry for abandoning this blog for such a long time with no explanation. I guess I have ben in denial myself until now, but I’m having major health problems right now and haven’t been able to work for the last few months. I was told today that this situation won’t change for quite a while. Since I’m not working, I’m not up to date on any news regarding immigration and how the offices handle changes. Therefore, I sadly don’t feel qualified to continue running this blog anymore. If any of you think you can do it, please IM me with some details about yourself. Hi, ich bin Deutsche und mein Freund ist Brite. Nun wissen wir natürlich nicht, was brexitmäßig wirklich passiert, aber sollte es so enden dass Briten keine Sonderrechte haben und so wie die meisten anderen Nicht-EU/Schengen-Bürger behandelt werden: Würde eine Heirat garantieren, dass er mit mir in Deutschland leben könnte? In Großbritannien ist das nämlich anscheinend nicht der Fall.

Hi, also eine 100%ige Garantie kann ich dir nicht geben, aber grundsätzlich hast du als Deutsche das Recht darauf, mit deiner Familie (also Ehepartner und Kinder) in Deutschland zu leben, solange ihr auch tatsächlich eine Lebensgemeinschaft führt. Euer Lebensunterhalt muss gesichert sein, wenn ein Ehepartner deutsch ist, ist allerdings auch der Bezug öffentlicher Leistungen möglich.

How is the job situation in Germany, in case someone is hoping to work and go to school there?

That depends on the field of work. We’re desperately in need of any kind of medical staff, engineers and IT specialists right now. I’m sure I’m missing something though. And just because you’re a foreigner specialized in a field that isn’t understaffed doesn’t mean you won’t be able to find a job. If you’re better than the other applicants, the job is yours.

Gilt das mit der Heirat auch für die eingetragene Lebenspartnerschaft?

Ja! Leider wird unsere Community in Deutschland ja immer noch von Behördenseite diskriminiert, aber im Ausländerrecht werden Lebenspartnerschaften wie Ehen behandelt.

Mein Freund ist Amerikaner und möchte nach der High School nach Deutschland ziehen und hier auch zur Uni gehen. Weißt du, was man da beachten muss? Weiter wäre meine Frage noch, ob es uns einen Vorteil bringen würde, zu heiraten (das haben wir sowieso vor)? Welche Rechte erhält mein Partner eigentlich durch eine Hochzeit? Dickes danke, dass du diesen Blog leitest!!

Eine Heirat würde ausländerrechlich sehr großen Sinn machen. Um einen Aufenthaltstitel fürs Studium zu bekommen, muss man 12x 735€ auf ein gesperrtes Sparkonto legen und darf pro Monat nur einmal 735€ abheben. Alternativ kann jemand für ihn eine Verpflichtungserklärung abgeben, dafür muss diese Person aber ein relativ hohes Einkommen haben.

Solltet ihr heiraten, fällt das komplett weg. Der Lebensunterhalt muss zwar trotzdem gesichert sein, solange ein Ehepartner deutsch ist, kann das aber auch durch Sozialhilfe geschehen. Wenn ihr verheiratet seit, muss er innerhalb eines Jahres das Sprachlevel B1 erreichen, sonst wird der Aufenthaltstitel wieder nur für ein Jahr verlängert. Wenn er sowieso studieren möchte, muss er für die Uni in der Regel ja sowieso einen Sprachkurs machen.

Solange ihr verheiratet seit, ist es fast unmöglich, keinen weiteren Aufenthaltstitel mehr zu erteilen, da ein deutscher Staatsbürger das Recht dazu hat, mit seiner Familie in Deutschland zu leben.

How does the international student program work if they don't speak German?

If you’re planning to major in something like international business, you don’t need to be able to speak German beforehand because your classes will be in English. You’ll attend a German class too though.

If you’re planning to major in something that’ll be taught in German, you’ll have to attend a full-time German course and reach level C1 before you can actually start going to university. Most unis offer those courses themselves.

You’ll be able to get a residence permit for that purpose. To obtain it, you’ll have to have a Verpflichtungserklärung (declaration of commitment), which is a document someone signs to declare that they’re paying for all your expenses or you have to have a blocked bank account with €735 for every month in it. You’ll be able to withdraw that amount every month to pay for your expenses. If you’re in the full-time German course you’re only allowed to work during breaks, as a university student you’re allowed to work 120 days a year + breaks.

I'm American, but my father is a German citizen, and was born in Germany. Could I apply for citizenship due to that?

This isn’t my department, so I read on on it and it depends. Your father will have to declare that he is in fact your father. It has to be done in a way the German government recognizes (you’ll probably have to start the process at a German embassy). It has to be done before you turn 24. So if you’re older than that already, it’s not possible anymore.

Habe immernoch den serbischen Pass obwohl ich seit 17 Jahren hier lebe (nicht hier geboren). Habe ich ein Recht auf eine doppelte staatsbürgerschaft?

Einbürgerung ist nicht mein Fachgebiet, aber laut Gesetz ist die doppelte Staatsbürgerschaft nur in Ausnahmefällen möglich, wenn du nicht in Deutschland geboren bist. Nachlesen kannst du es hier: https://www.gesetze-im-internet.de/rustag/BJNR005830913.html (§12 StAG).

ist wahrscheinlich auch nicht dein Gebiet, aber weißt du ob man was dagegen machen kann wenn man das deutsch Wahlrecht nach 10 Jahren im Ausland verliert? meine Eltern wohnen seit bald 10 Jahren in Österreich und verlieren demnächst das deutsche Wahlrecht, obwohl sie super politisch interessiert sind und auch noch viel mit Deutschland zu tun haben, und ich finde das nicht ganz fair :/

Ich habe die italienische Staatsbürgerschaft (Eltern sind Italienerin und Spanier und ich musste mich irgendwann entscheiden), bin in Deutschland geboren, habe hier Abi gemacht und studiert. Was genau sind die Schritte und die Kosten für die Einbürgerung? Was ist mit Doppel-Staatsbürgerschaft (Deutsch-Italienisch), geht das? Danke danke danke für diesen Blog!

Leider weiß ich nich allzu viel über die Einbürgerung, weil das in meinem Amt eine separate Abteilung ist. Grundsätzlich ist eine doppelte Staatsbürgerschaft aber seit kurzen möglich, Vorraussetzung für die Einbürgerung ist Straffreiheit und ein gesicherter Lebensunterhalt (also kein Bezug von Jobcenterleistungen oder Sozialhilfe). Da du in Deutschland geboren bist sollte das ganze relativ unkompliziert sein. So, I am german, but next to my dorms there is a Asylantenheim. I was wondering: what is provided for Asylanten in this building? Is there a list on what items the state provides for them? That way I could figure out what maybe is needed.

This is not my department, but I can tell you that the people living there don’t get much space for themselves. The laws about this vary from state to state, those are the resources I could find (they’re not very new and things might have changed, sorry!):

There are places like AWO, Diakonie and Caritas in basically every city, they should have a pretty good idea of what’s needed as well. Some city governments are collecting things like clothes or toys in some offices too. Mine does anyway.
