In this whole darkness of horrible things happening outside, suddenly we got unexpected positive news in Poland:
Our Supreme Court decided that it's against the constitution for trans people to sue their parents if they want to change their gender in documents. And they actually don't have to go to court to sue anyone, because it should be treated as the non procedural processing.
Before that, suing your parents was a "standard" procedure in Poland for trans people - which not only had been extending the whole procedure of transition (the record goes to the person who was fighting for their right 5 years), but also if someone had toxic relationship with parents (or their parents were dead/unknown) it could bring back the trauma and/or extend the procedure even more.
And now, our Supreme Court basically said "welp, we looked at this closely and this is irrational that we are basing this whole procedure on some outdated law from 80's. There is no reason to sue parents or do it with a procedural processing path because no one actually did any harm. Also our courts are over flooded by thousands of other cases, we don't have time to do something that it could be done as simple rectification of a civil act."
This is such big news for people here in Poland! When the whole world is attacking trans people - suddenly this kind of decision is decided in one of the most homophobic countries in the EU!
Of course it's not perfect, we don't know how it will work in the practice (if juries won't act like before, not noticing the new change in the law which surprisingly happens A LOT OF TIME here) and no one knows what about the current cases that still wait for results in courts. It's still complicated with all "required" papers from doctors - plus nonbinary people basically don't exist in Polish law....
But still! A small step to better future 💖
And the biggest joke here is - it was the result of the procedure that started in 2021 by the former Minister of (in)Justice, who wanted to make the whole procedure even more difficult and he absolutely did not expect that the Supreme Court would give him a completely different answer. What an irony 💅✨
