Ched Evans and Consent

Spending the last 10 years of my career both sat at my desk reviewing files, and being on my feet in Court, arguing the finer points of the legislation, I am not surprised by the backlash of the Ched Evans case. The decision to charge in a rape case is difficult enough. The 'normal' case is a one - on - one with no other witnesses, no one to check and confirm the complainant's demeanour. This case seems to be 'exceptional' as evidence about the victim's previous and subsequent behaviour was similar to that alleged by the defence on the night. And that is the reason why it was admissible in the retrial. The decision was then a jury issue. The only question I do have is, where were Evans' brother and friend? They apparently were voyeurs, watching the scene through the window. Surely they were the key witnesses here? Objective watchers, being able to see whether the complainant at least looked like she was consenting. Where have they been during the past five years?
