Also, choosing this defense means that the defendant DID commit the act or that the prosecution has met their burden to show that defendant did commit the act. However, this defense is only available for murder charges — not weapons charges.

One good thing is that the burden of proof is lower for extreme emotional disturbance. Usually, the burden of proof in criminal cases is “beyond a reasonable doubt”, but this defense must only be proven by “a proponderance of the evidence.” I’ll go more into that later too!
