Who Has The Right To Custody In Case of Divorce
ʿAbd Allah b. ʿAmr reports that a woman came to the Messenger of Allah ﷺ and said: “O Messenger of Allah, indeed my son grew in my stomach and was nursed upon my breasts and was sheltered in my home. His father divorced me and now he wants to take him from me.” حدثنا رَوْح حدثنا ابن جرَيج عن عمرو بن شعَيب عن أبيه عن [جده] عبد الله بن عمرو: أن امرأة أتت النبي -صلي الله عليه وسلم -، فقالت: يا رسول اِلله؛ إن ابني هذا كان بطني له وعاء، وحِجْرِي له حواء، وثَدْيي له سقاء، وزعَم أبوه أنه ينزِعه مني؟ So he said to her: “You have more right to him as long as you do not re-marry.” قال: "أنتِ أحَقُّ به ما لم تنكَحي". The chain is Ṣaḥīḥ. It was reported by Abū Dāwūd #2276 by way of al-Awzāʿī from ʿAmr b. Shuʿayb. إسناده صحيح، ورواه أبو داود 2276 (2: 251 عون المعبود)، من طريق الأوزاعي عن عمرو بن شعيب.
