I do think the law is equal for everyone - with two major critical notes.
First of all, yes, the law is equal to all. In the law system, there are no or minimal exceptions for different classes. No law will dictate that, for example, the minimal penance for a woman is five years, and for a man ten years.
However, precisely because it is equal in principle, it is unequal as well. Imagine a CEO speeding on the high way. He receives a fine of, let us say, 200 euros. Assuming that his monthly wage is counted in numbers with four digits, that fine is but a small, almost negligible portion. Imagine the same fine being applied however to a single mother with two children and a part-time job. The weight of the fine is thus distributed unequally.
That’s why exercisers of the law are almost forced to write out punishments unequally. This can be a positive thing of course (it’s ridiculous to keep demanding a high fine if the offensive party cannot pay it - in that case a smaller fine is more rewarding), but it can be negative as well. After all, because one cannot apply to law equally to all, one has to make decisions - and these decisions are influenced by non-rational factors as well, such as prejudices or personal convictions. Thus, the behavior of the suspect in front of the court, can in a large way determine the penance he or she will receive.
I admit this is rather abstract. However, if you know dutch, there is a very good program you should watch, called de Rechtbank (the court of justice). It is a reality program, in which they filmed in different courts and just show the reality of every day, with all kinds of crimes and parts of the justice system. It gives a really nice image of the workings of the law.
