Welcome to the Forty-Fifth Day
There are at least 35 legal cases that have blocked the Trump administration's abuses of power, at least temporarily.
Let's talk about one. I've chosen Dellinger v. Bessent.
The Office of Special Counsel is the office that government employees call to blow the whistle on government agencies or officials doing illegal or immoral things. Hampton Dellinger was appointed to be Special Counsel (head lawyer) by Biden on March 6th, 2024. Trump ordered Dellinger fired as Special Counsel on February 7, 2025, giving no reason. On February 10, Dellinger sued Scott Bessent, Trump's Secretary of the Treasury, alleging that federal law only allows a special counsel to be fired due to "inefficiency, neglect of duty, or malfeasance in office." The case was heard before Judge Amy Berman Jackson of the DC District Court, who issued a temporary restraining order (TRO) requiring Dellinger to be restored to office until the case ended, and schedule the merits hearing (the real trial) for Feb 26. The Trump administration appealed to the DC Appeals Court, who upheld the TRO on Feb 15th, and then to the Supreme Court, which on Feb 21st upheld the TRO (with two of Trump's three appointees siding against him; Gorsuch was the exception). On Feb 26th, the case went back to Judge Jackson of the District Court, who extended the TRO to March 1st then, on March 1st, ruled decisively in Dellinger's favor. The firing was illegal, she declared, and therefore null and void. Dellinger remains the Special Counsel until the end of his 5-year term unless he actually does something wrong, and any recognition of someone else as an Acting Special Counsel is a violation of the law. Trump's side has filed an appeal to the Circuit Court on March 3rd.
