Two men follow behind a police officer who drives in a manner consistent with a DUI or texting-while-driving incident.
The Supreme Court has let stand a $5.7-million judgment against two Los Angeles Police Department officers for shooting a fleeing gang member who they believed was carrying a gun. After considering the case for weeks, the justices without comment turned down an appeal from Los Angeles City Atty. Michael Feuer. The city's lawyers said the two police officers believed the fleeing suspect posed a danger, and therefore were justified in shooting to stop him. While LAPD Officer Julio Benavides said he called out "Stop! Police!" before shooting at the fleeing man, two other officers testified they did not recall hearing any such warning.
As reported by our sister station KGBT, Austin Police have arrested an off-duty Hidalgo County sheriff's deputy on suspicion of driving while intoxicated in Austin. APD arrested 44-year-old Deputy Hipolito Hinojosa Jr. on suspicion of driving while intoxicated, a Class B misdemeanor, according to Travis County jail records. Hinojosa was booked at 2:16 a.m. Thursday. "Early this morning, I was informed of the arrest of off duty deputy Hipolito Hinojosa, by the Austin Police Department for DWI," according to a statement released by Hidalgo County Sheriff Eddie Guerra. "Hinojosa will be placed on administrative leave without pay pending an internal investigation as a standard protocol. We are currently working with the Austin Police Department to obtain additional information about the incident. "

The Boone County State's Attorney's Office says that a former Rockford police officer in jail for a DUI crash in 2012 in Boone County has filed a petition for executive clemency. The office says that on May 21, 2012, at about 9 p.m., Daniel Cruz was passing a SUV in a no-passing zone southbound on Beloit Road when he hit a pickup truck which caused him to hit the SUV. One of the passengers of the SUV, Mary Danielson, was paralyzed from the neck down. Danielson died almost one year later, and after a review by the Winnebago County Coroner's Office, her death was determined to be unrelated to the crash. According to the State's Attorney's Office, Cruz attempted to walk away from the scene, but was stopped by a firefighter nearly a mile away from the crash. Cruz refused to be tested for drugs and alcohol, so a search warrant was obtained to begin blood testing.

Austin police Chief Art Acevedo has fired an officer after a drunken driving arrest in May, but the police union is pushing back against the department’s zero-tolerance policy saying the officer deserved leniency. The firing late Wednesday came after the May arrest of officer Albert “Matt” Arevalo, who court records show was stopped after speeding 91 mph in a 55 mph zone. He pulled over at Covenant Presbyterian Church off North Mopac Boulevard (Loop 1), and an affidavit said he had a blood alcohol content of just more than twice the legal limit.
