TEA EB-5 2026: Đầu tư 800.000 USD, nhưng không phải dự án nào cũng có cùng lợi thế
TEA – Targeted Employment Area – là khu vực được ưu tiên trong chương trình EB-5, cho phép nhà đầu tư tham gia với mức vốn tối thiểu 800.000 USD, thấp hơn 250.000 USD so với dự án ngoài TEA.
Theo quy định hiện hành, TEA gồm hai nhóm:
Rural TEA: khu vực nông thôn, ngoài vùng đô thị thống kê và không thuộc địa phương có dân số từ 20.000 người trở lên.
High-Unemployment TEA: khu vực có tỷ lệ thất nghiệp đạt ít nhất 150% mức trung bình toàn quốc.
Điểm quan trọng là hai nhóm này không có quyền lợi hoàn toàn giống nhau. Rural TEA được dành riêng 20% hạn ngạch visa EB-5 và được USCIS ưu tiên xử lý hồ sơ. High-Unemployment TEA có 10% quota riêng, nhưng không được hưởng cơ chế ưu tiên xét duyệt như Rural.
Từ RIA 2022, USCIS trực tiếp xác định tư cách TEA dựa trên dữ liệu liên bang. Tình trạng TEA được xem xét tại thời điểm nộp I-526E, giúp hạn chế rủi ro khi dữ liệu dân số hoặc thất nghiệp thay đổi sau đó.
Tuy nhiên, TEA không phải bảo chứng cho thành công. Nhà đầu tư vẫn cần đánh giá nguồn vốn, khả năng tạo ít nhất 10 việc làm, cấu trúc tài chính, tiến độ dự án và chiến lược hoàn vốn.

EB-5 tháng 7/2026: Việt nam tiếp tục “current”, Ấn Độ tạm hết visa
Visa Bulletin tháng 7/2026 tiếp tục ghi nhận tín hiệu thuận lợi cho nhà đầu tư Việt Nam. Cả EB-5 Unreserved và ba nhóm visa dành riêng gồm Rural, High Unemployment và Infrastructure đều ở trạng thái Current trong cả bảng Final Action Dates và Dates for Filing. Điều này đồng nghĩa hồ sơ Việt Nam hiện chưa bị giới hạn bởi ngày cắt visa.
Trong khi đó, EB-5 Unreserved của Trung Quốc có Final Action Date là 1/12/2016. Riêng Ấn Độ chuyển sang trạng thái Unavailable do đã sử dụng hết hạn mức được phân bổ cho năm tài khóa 2026; visa dự kiến chỉ có thể được cấp lại khi hạn mức mới bắt đầu từ ngày 1/10/2026.
Tuy nhiên, “Current” không có nghĩa I-526E được duyệt ngay hoặc chắc chắn nhận thẻ xanh. Nhà đầu tư vẫn phải vượt qua quá trình thẩm định nguồn tiền, đường tiền, dự án, khả năng tạo việc làm và điều kiện nhập cư cá nhân.
Tháng 7/2026, USCIS yêu cầu hồ sơ việc làm đang điều chỉnh tình trạng tại Mỹ sử dụng bảng Final Action Dates. Nhà đầu tư nên theo dõi lịch visa hằng tháng vì retrogression vẫn có thể xảy ra khi nhu cầu tăng.
