The Prohibition of Distributing Free Samples of Tobacco Products
This guidance is intended to help tobacco product manufacturers, distributors, and retailers understand the prohibition of distributing free samples of tobacco products set forth in Title 21, Code of Federal Regulations (CFR), Part 1140 and to explain what you should do in order to comply with the regulations.
The document explains, among other things, what activities and which persons are subject to the regulations, as well as how the prohibition of distributing free samples apply to the distribution of tobacco products through:
1, non-monetary exchanges;
2, membership and rewards programs;
3, contests and games of chance; and
4, business-to-business exchanges.

FDA rethinking ban on blood donations by men who had sex with men
Men who have had sex with other men will be allowed to donate blood under some conditions if the U.S. Food and Drug Administration finalizes “draft guidance” published on Tuesday.
Men who have had sex with another man (MSMs) even once since 1977 are banned from donating blood in the United States as they are recognized to be at a higher risk of contracting HIV.
MSMs are not restricted to homosexual men.
If approved, the ban on blood donations would be lifted for those who have not had sex with another man in prior 12 months. After publishing draft guidance, the FDA invites comments and holds public hearings. The FDA may then also seek expert recommendations before making a final decision.
Some experts indicated support for a change in the rule on blood donations by MSMs in an FDA panel discussion in December, but did not make any recommendations.
The Department of Health and Human Services voted 16-2 in November in favor of changing policies to allow blood donations by MSMs if they have not had sex with another man for a year.
The draft recommendation suggests deferring donations from women who have had sex with an MSM by 12 months.

Gay and Bisexual men still banned from giving blood
Hey everyone, So the FDA still bans gay and bisexual men from giving blood. This policy was first put in place in 1983 under the assumption that all gay or bisexual men have AIDS or hepatitis B. The FDA has since added a survey question saying "have you had sexual contact with another male, even once?" If you answered yes, the result is a lifetime ban from giving blood. This ban needs to be lifted because it is one of the only notions left in government that supports the assumption that all gays have AIDS.
Theres a petition which will call the FDA to end their ban against gay and bisexual male blood donors. It needs a total of 100,000 signatures by July 31st, 2014 in order to be passed. But only 17,859 have been gathered so far, leaving 82,141 left. So share this with people, we need as many signatures as we can get. Thanks!
