This is What It's Like to be A U.S. Guest Worker

The U.S. agriculture system relies on migrant farm workers from Mexico. The H2-A Visa program brings about 66,000 people from Mexico to fill these jobs, although I believe the estimate that I recently read was anywhere from 1 to 3 million farmers from Mexico are here without papers. Without guest workers, we're lacking a very critical labor force that helps feed American families. For workers who have a good experience, they're making money for their families while helping feed American families. Without their labor, I've read report after report, particularly in agriculture, where farmers cannot find Americans to work for the wage that they're giving. If we don't have people out there to process our food, that could have a huge effect on our economy and livelihood in the U.S.

Senator Sessions Summarizes Findings On Corporate Abuse Of Guest Worker Programs

U.S. Sen. Jeff Sessions (R-AL), Chairman of the Subcommittee on Immigration and the National Interest, issued the following statement after the Judiciary Committee held a hearing on the displacement of U.S. workers through the H-1B and related guest worker programs:

“In 2013, columnist Byron York called attention to a curious and alarming fact: the same companies lobbying for more guest workers were laying off American workers in droves.

Chairman Grassley leaves no doubt as to what is happening: large corporations are using foreign worker programs explicitly for the purpose of replacing American workers at lower wages. This is exactly what happened to hundreds of loyal workers, mothers and fathers employed by Southern California Edison.

I would like to thank Chairman Grassley for holding this important hearing, and for his leadership. I would also thank to thank two of our independent witnesses today, Professors Ron Hira and Hal Salzman, recognized as the top experts in their field. In written and oral testimony before the Senate, they and their colleagues have established these facts beyond doubt:

The current large supply of guest workers into the STEM labor market is displacing U.S. workers and depressing their wages.

American schools graduate twice as many students each year with STEM degrees as there are STEM jobs to fill.

The primary use of the H-1B and other IT-related guest worker programs is to either replace Americans workers at lower wages or to fill open jobs with workers at lower cost—it has nothing to do with trying to find the “best and brightest.” In fact, our current guest worker and green card policies discourage and displace talented Americans from realizing their dreams.

Increases in guest workers and university-based green cards in legislation such as the ‘Gang of Eight’ bill, I-Squared, and the SKILLS Act, would provide a large enough labor supply to allow tech companies to fill 100 percent of available jobs openings with foreign workers.

The day is over when high-paid immigration lobbyists can simply demand as much labor as they want at the lowest possible price. By a nearly 10-1 margin, Americans of all backgrounds say companies should raise wages and improve working conditions before bringing in more labor from abroad. Wages are down, record numbers aren’t working, and welfare is at all-time highs—it’s long past time to get people living here today back to work. The national interest, not the special interests, must guide our immigration policy.”

Critique of a new agricultural guest worker program in New America Media that states:

Agribusiness wants a new guest worker program, and complaints of a labor shortage are their justification for it. 

Not sure... but I believe this column is in response to the Agricultural Guestworker “AG” Act (H.R. 1773) that was approved by the House Judiciary Committee in June 2013. According to the press release (linked above):

This bill creates a new temporary agricultural guestworker program to provide American farmers with access to a reliable workforce. 

...

“In contrast to the current, bureaucrat-driven H-2A program, the new guestworker program created under the AG Act is a market-based approach that removes red tape, streamlines access to a reliable workforce, and protects farmers from abusive lawsuits. It also allows more participation in the guestworker program by opening it up to dairies and food processors, both of which often need access to foreign labor. In addition, the AG Act is good for those seeking a better life for their families by providing opportunities to earn a living while temporarily working in agricultural jobs U.S. citizens are not willing to do. 

Very suspect language that privileges the convenience of the employer over the rights of the laborer.

Workers Claim Race Bias as Farms Rely on Immigrants

"As Congress weighs immigration legislation expected to expand the guest worker program, another group is increasingly crying foul — Americans, mostly black, who live near the farms and say they want the field work but cannot get it because it is going to Mexicans. They contend that they are illegally discouraged from applying for work and treated shabbily by farmers who prefer the foreigners for their malleability.

“They like the Mexicans because they are scared and will do anything they tell them to,” said Sherry Tomason, who worked for seven years in the fields here, then quit. Last month she and other local residents filed a federal lawsuit against a large grower of onions, Stanley Farms, alleging that it mistreated them and paid them less than it paid the Mexicans."

The latest problem is how to decide the future flow of workers that won't disrupt wages of American workers.

The aim is to avoid driving down wages for American workers by maintaining the existing H2-B mechanism that sets wages for new workers.

Republicans turned down that proposal, Hauser said, surprising Democrats, who believed other elements of the future flow agreement had addressed GOP concerns.
