Net Neutrality

Reminder to NOT ignore the current Net Neutrality fiasco! Please sign the pledge and/or do whatever you can to stop them before they end up taking away what we love about the internet.

Normally I don’t pay attention to politics or social affairs. The US isn’t the smartest country, I’ll admit to that, and sometimes I’m fairly ashamed of the actions that have been taken. But this right here- the actions so many are taking to remove our freedom of speech online and remove our privacy, is horrendous and I refuse to let it go without fighting like hell to save it.

I will be affected by this, like you will. For example- I am in a long distance relationship. If net neutrality is repealed, my ability of keeping contact with my significant other will be horribly altered. What if I’m forced to pay money for Skype? For Steam, so we can play games together in the time we normally spend with one another? The normal things we do will suddenly become burdensome and expensive.

In another example, what if you want to find a job? Information about workplaces, schooling, etc? How can you do that if your search engine charges you for its usage? It’s already hard enough to save money in our country, but with added expenses like these, the internet will fall into ruin in itself. Many people who use the internet nowadays are young and just starting out on their own. The FCC doesn’t care that we, the younger generations, will have to mostly pay for their scheme for more cash grabbing.

The normal things you do every day can and most likely WILL be impacted if it is repealed. The only thing the FCC wants out of this is more money, and they aren't thinking about the absolutely horrible consequences of repealing net neutrality laws.

Just imagine having to pay extra money for Wikipedia. Youtube, your blogging site, Twitter, Facebook- even Google itself. Think about the normal things you do on the internet every day, and how you take for granted how easily accessible things are. Your privacy will also be invaded- they’ll be able to see what you do online unless you take special precautions. 

The US may not end up the only ones affected by what’s going on. even if you live outside of America, you can still help and find ways to stop it with us. I ask of you, please- don’t ignore what’s going on!

There is less than ONE week to rally together and stop them from repealing it. Please don't let this happen- fight to keep your privacy and freedom online!

Guess what? We may see baby Quackers in a month! Also, we may not. 😏 They may not all be fertilized. Or I may do something wrong. Like letting them cool a bit each day & spritz with water later on, recreating the 'mom leaves the nest to take a break & comes back with wet feathers' scenario. I'll start tonight with the numbers ⬆️ after turning several times today. Internet and the Law

This was the coolest course ever. Although we had to work, I must admit that I loved the assignments and discussions. Even, the videos were a little hilarious with the professors “little helper/assistant.”

Before this class, I had never thought to stop and read the terms and conditions or the Privacy Policy page on websites where I register my information. I now realize that I could possibly sign my life away and not even realize it until it was too late. The things listed on some of these pages are ridiculously outrageous. How could these people get away with some of the things listed as an agreement to say? “The lack of knowledge!” I now truly understand why they say, “reading is fundamental.” I really don’t have a favorite assignment or discussion in this class, because I loved each and every one of them, which is unusual and maybe a first for me. Although, it entitled us to push our research skills a little more, this was a very information and learning course and there isn’t much of any thing I would change about it, besides maybe have more time to gain more information. There should be like a part one of this course taught right after Mastery and then part two in the middle and the final part at the end. There are so many laws being created and passed each day.

As I approach the end of this journey, this chapter in my life, as always I want to thank Full Sail for giving me the opportunity to better my self, to discover my hidden treasures, and to make new life time friends. This course and all the others has been a building block, some blocks were a little bigger and hard so I stumbled, but I over came each one. I love Full Sail and the Full Sail family.

Section 230 & Unfair Competition - Taylor v. Twitter

Section 230 of the federal Communications Decency Act facilitates the interactive Internet. It states that “no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.”  

In other words, if someone makes a defamatory comment on YouTube, YouTube isn’t responsible.

The law also bars claims that “seek to hold a service provider liable for its exercise of a publisher’s traditional editorial function – such as deciding whether to publish, withdraw, postpone or alter content,” in part so that service providers may block and screen offensive material. (Barrett).  That helps Twitter, Facebook, YouTube, etc. in cases where (mostly pro se) litigants claim their content is targeted and removed.  Advocates say it’s critical in curbing trolls and hate speech.  Critics say it’s censorship.

Most courts interpret Section 230 broadly and such cases are quickly dismissed.  However, activists and large organizations attempt to plead around Section 230 by claiming First Amendment, negligence, and breach of contract violations.  These claims have also largely been dismissed, but in Taylor v. Twitter one judge criticized the broad application.  

The plaintiff, Jared Taylor, owns a publication called American Renaissance. Twitter suspended Taylor’s account because his posts violated Twitter’s terms of use.  Most of the claims were dismissed based on Section 230, but the Superior Court Judge Harold Kahn allowed an Unfair Competition Law (UCL) claim to proceed.  Subsequently, the appeals court directed the judge to explain his decision or dismiss the claim.  

On review Judge Kahn ultimately dismissed the UCL claim, holding that California state courts determine “the practical reality of what the plaintiff sought…rather than the way the plaintiff framed her case.”  But, the judge noted that the complaint against Twitter was not frivolous despite Section 230, given that multiple federal decisions support plaintiffs pleading around Section 230 and the Supreme Court may ultimately adopt the plaintiff view.  He (sarcastically?) explained:

“I went astray in believing until recently that the determinations of whether plaintiffs seek to hold Twitter liable as a publisher and whether plaintiffs’ UCL claim is based on Twitter’s speech or plaintiffs’ own speech are distinct inquiries. …I now realize that these seemingly different issues are actually the same issue, merely expressed in different language.“

That’s either a rare admission of error or an unsubtle way to follow precedent and guide the appellate courts.

Internet and The Law Reflection Post

This month was a very intense course Im happy I got to go through what Internet Law is all about and its a much needed course when understanding Internet marketing entirely. Within the first week after covering jurisdiction and copyrights I got a good understanding of if states can sue defendants that are not citizens but have business within the state which is good to know and steps U.S courts perform before claiming jurisdiction. Its interesting to know that the Zippo test and the Effects test come into play before anything jurisdiction is determined, each test depending on actions and intentions and if any damage was caused intentionally. I also really enjoyed learning more about copyrights because I have always been into music and hold a degree in entertainment business and understand the ins and outs of the entertainment industries. While getting refreshed on copyrights there are also things I still was able to learn including how Bill gates of Microsoft had a big part in the 1980s on why software is now protected under law, Bill Gates claimed  “copying was the key into turning digital products into wealth.” It was also cool to get in depth on peer to peer file sharing and understanding how that alone had a big impact on the music industry far as copyrights goes and understanding the negative effects of it. Each week I feel we had important topics that makes up Internet Law and the importance of it showing us do’s and don’ts of each aspect. The introduction to cybercrime was defiantly a real eye opener as well and the debates on the topic helped a lot. Learning about the different laws that came into play just because the internet is beginning to become more vast was interesting to know, laws such as the Identity theft penalty enhancement act on how it protects internet users and if the penalties are strict enough for cyber criminals stemmed great discussions. The class had a chance to look at statistics and how cyber criminals are growing in numbers as well as their techniques and how their getting more clever and things you can do to protect yourself was very important to know. Learning how companies also protect themselves from cyber-criminals is most important because its a lot of data and sensitive information companies can’t afford to be leaked, utilizing attorneys, having information backed up on cloud storage and hiring 3rd party defenses were all important factors in protecting sensitive information. Also learning about that all spam isn’t bad was intriguing as well, learning about the Can-Spam act and how it was implemented by George W. Bush in 2003 and the fines of up to $40,000 if you violate the terms of the act was good to know. I also learned how some people make a good living off of spam alone and terms like “constitutionally permissible” placing spam under a form of protected speech by the first amendment making it within compliance of the Federal trade commission. I also really enjoyed how we would as a company work “spam” into our marketing strategy this was helpful because as an entreprenuer as myself it gave me alternative ways to think outside the box and in the future possibly how I can use spam as a benefit, seeing it in a positive light instead of a negative one. Everything in this course was helpful an would help me on my journey to mastery especially the use of privacy and privacy policies and the importance they are to any website when your in business. Privacy policies may not be read as often as companies would like to be but they can also help protect you from lawsuits in the long run so its important to implement one just in case people do decide to glance at them so at least some important things are spelled out there. Everything I learned in this class was meaningful and will help me as I establish my own company and begin to do business online, it’s been fun.
