Kleine said there was consensus among law enforcement that the bar owner's actions were justified.

this is in my state. during a peaceful protest, known white supremacist, jake gardner, fired warning shots into the crowd with a weapon he was not legally allowed to carry. james scurlock, unarmed, threw himself on gardner to protect the protesters from the shots. gardner proceeded to shoot scurlock in the neck, causing his death. county attorney, doug kleine, announced this afternoon that there will be NO charges filed against gardner. 

to reiterate: jake gardner was in possession of a firearm with an expired consent to carry permit. nebraska DOES NOT have a stand your ground law. despite claims from police officials, video evidence and personal accounts show that gardner was shooting BEFORE scurlock threw himself on him. despite all this, absolutely NO CHARGES will be issued, not even unlawful possession of a lethal weapon. 

i have ten thousand followers on this blog. i’m asking each and every one of you to make sure the world knows james scurlock’s name, and make sure everyone knows that he was murdered in cold blood by an outspoken racist, who, hours before, made threats on social media about shooting down protesters, and then proceeded to do just that.

Nebraska State Sen. Justin Wayne who is acting as representative of Scurlock's family said it was disappointing Kleine met with community leaders about the decision not to press charges before telling Scurlock's father.

"In this community, we prosecute black and brown individuals a lot more for things like we just watched," Wayne said. "(Gardner) had an unlawful carry concealed weapon."

Kleine said Gardner had a carry concealed weapons permit but it was expired at the time of the shooting.

He said the facts of the case described by Kleine were "a credibility issue" but that is decided by a jury, not a judge. Wayne asked for a grand jury to be formed.

"We watched a video where anybody else would have gotten charged with something," he said. "We are asking for a grand jury and charges to be brought against (Gardner)."

Justice for James Scurlock

James Scurlock, a 22 year old black man, was murdered May 30th while attending a protest for the death of George Floyd in Omaha, Nebraska. The shooter, Jake Gardner, is a business owner in Omaha with a very racist past. Witnesses and video from the May 30th shooting show Gardner using racial slurs while pointing a loaded weapon at protesters moments before Scurlock was killed. It appears Gardner was standing outside of one of his businesses to protect it from damage during the protests.

Gardner has been taken into police custody though it is uncertain whether he was arrested or is being held for his own protection. Please contact the Omaha, Nebraska County Attorney Don Kleine and demand justice be served for James Scurlock.

Bottom line is... these cops wouldn’t even be standing trial if it weren’t for the riots. You can condemn it all you want while praising only the protesters...but we went from just the one officer being charged (which is success in of itself and that’s saying a lot) to ALL four officers being charged with 2nd degree murder; and people think we got there from protesting peacefully?? When:

Colin Kaepernick protested PEACFULLY and all he got was black listed

They protested in Ferguson, and all the activist were murdered (May they all rest in power ✊🏾)

And we protested for Trayvon Martin and Zimmerman’s big racist ass is out signing autographs

In a lot of cases (like this one) protesting only brings awareness, but it’s the riots that brought the results. But anyway, if you’re still upset about all the rioting this summer save yourself the embarrassment of being a hypocrite by not celebrating these riots this summer either:

Jake Gardner was found not guilty for the murder of James Scurlock admist protests and a state emergency because of said protests. He shot an unarmed black man who wasn't even on his property or doing anything wrong except protesting. Jake Gardner is a well known racist shop owner in downtown Omaha. The protests here are going to get worse because of this.

Hey guys, I haven’t seen much info about what’s happening here in Omaha so I wanted to share this GoFundMe dedicated to the young man who was killed during the protests here last night. 

James Scurlock was killed last night by Jake Gardner, owner of The Hive in Omaha ( who is already well known in the community for being vocal about his racist, homophobic views + practices) that brought it upon himself to come to the protest last night and start waving his gun at people, threatening them and being racist. When protesters tried to disarm him, he shot and killed James. This is all caught on video. Despite that Jake has ALREADY been released from custody.
