Stella Liebeck and The Truth About the McDonald’s Burn Case

One morning in 1992, Mrs. Stella Liebeck, a 79-year-old woman, purchased a cup of coffee at a  McDonald’s drive thru .  She was in the passenger seat; her grandson was driving.  Her grandson pulled ahead so Mrs. Liebeck could add some cream and sugar to her coffee.  Once she removed the lid from the Styrofoam cup the contents spilled onto her lap and were absorbed into her sweatpants, which then clung to her skin.

At the hospital the doctors determined that Mrs. Liebeck had suffered  3rd degree burns over 6% of her body, including her inner thighs, perineum, buttocks, genital and groin areas.  She spent 8 days in the hospital and had to have skin grafting.  After being burned, Mrs. Liebeck asked for only $20,000 to cover her medical bills.

In the context of the proceeding,  Mrs. Liebeck’s attorney argued that coffee should not be served at temperatures higher than 140 degrees.  The McDonald’s coffee, in contrast, was served at 190 degrees.  At this temperature,  a 3rd degree burn would occur within seconds of exposure to the skin.  Prior to this incident, there were over 700 claims of people being burned by coffee from McDonald’s, some of whom suffered the same burns as Mrs. Liebeck.

In the end, Mrs. Liebeck was awarded $160,000 in compensatory damages and an additional $2.7 million in punitive damage.  The judge reduced the punitive damage to $480,000 and increased the compensatory damage to $640,000.  Both parties ended up appealing this decision and in the end both parties settled out of court for an undisclosed amount less than $600,000.

This case is often used as an example of our judicial system run amok, but, as you can see from the above set of circumstances, the result of the lawsuit is hardly the travesty of justice people like to portray.  It actually seems to be a pretty fair outcome all around.

I think it's ridiculous how much people make jokes about Stella Liebeck for suing McDonalds for millions of dollars 1. She got third degree burns on her pelvic region. Have you seen what a third degree burn is? Look it up then picture it on your pelvis (cause you she spilt it on herself). The coffee was 180-190 degrees! That's too hot! She was in the drive and didn't have cup holders (was a mid to late 80s model Toyota) hence why the cup was in her pelvic area. Her pants absorbed the coffee and pressed it against her skin around her thighs, Butt groin which SCALDED her. 2. 6% of her body got 3rd degree burns and 16% got 1-2 degree burns 3. She had to get skin grafting which is expensive and painful 4. She DIDNT get millions of dollars, she got $640,000 which went to lawyer fees and medical bills (skin grafting and two years of treatment is not cheap. 5. McDonalds wouldn't even settle for $8,000 pre trial! At the time her already existing (not including future expenses or lost income) was $18,000. So no I don't think her trial was stupid or uncalled for, I think she had a legitimate case

Last month I stumbled upon a subreddit on law where a poster was asking about liability. In the comments, someone responded by mentioning the Liebeck v. McDonald's case in regards to products liability. Their response provided information I hadn't heard before, such as:

McDonald's had reports that their coffee had sent more than 700 people to the hospital with 3rd degree burns over the last 10 years, and had been routinely settling these cases for as much as $500K before Liebeck

The coffee was hot enough to cause 3rd degree burns in as few as 2 seconds exposure.

Reducing the temperature of the coffee from ~180 to ~160 would change that time to 20 seconds.

Before suing, Stella Liebeck asked McDonald's to help her out and pay for her copay and deductible for the 2 years of medical treatment required because of the skin grafts.

Today, a friend posted a link to the video above about the case. It's definitely worth your time to watch. There are a lot of interesting points from a legal perspective. It's also a reminder of the power the news media carries, on how it presents an issue and shapes a discussion.

It's really unbelievable what happened to Stella Liebeck. You just have to watch to see how the media turned on this little old lady who lived in Albuquerque. Obviously a villain, right?
