I wrote an essay for school in relation to the MAMDANI and thought I’ll share it on tumblr, I kept everything the same as my school essay but got rid of my state district also credits to Lady Lzidhar I used a some of her research for this. My name is Olivia and I am a constituent of district (I’m not doxxing myself ) writing to you regarding your introduction of the MAMDANI act. If this act was passed, it would “amend the Immigration and Nationality Act to allow for the denial of entry, deportation, denial of citizenship, or denaturalization of any immigrant who advocates socialism, communism, "Chinese communism", or Islamic fundamentalism, or who is or was a member of a party or other organization advocating those beliefs”. Although people who fall into this category would seem dangerous to “American Values" the act is incredibly vague and would allow the deportation of just about anyone.
In the text of the bill itself, it says “Someone can be deported because of not only affiliation or membership of a party, but for advocacy.” Advocacy means writing, distributing, or even possessing materials that promote ideals. But since this wording is so vague, one could argue simply learning how to juggle could be labeled as communist material. During the Soviet Union juggling schools promoted ideologies of discipline, it was also very popular so naturally a lot of juggle theory and methodology came out of it. In court would practicing the art of juggling be argued a communist material and therefore worthy of deportation?
The most enraging part is there would be no court, sense “not with standing any other provision of law, any determination made under this subparagraph shall be final and shall not be subject to review by any court.” This was not the first time an act like this was introduced to the US, from 1919 to 1920 during the first red scare a US attorney carried out the Palmer Raids and around 10,000 people were arrested across the country. Homes were intruded without warrants, many were detained without any clear charges. If this bill was to pass the US house of representatives and the senate it would be a mere copy of the same mistake we made almost 100 years ago.
This topic is very important to me because this would directly contradict our founding fathers will, in the first amendment they guarantee our god given right of free political speech in America. This would also affect me due to having family and friends living under the CCP better known as the “Chinese Communist Party,” with Chinese history and its ties with communism, would simply having Chinese blood be enough affiliation to be detained and deported out of a country built on immigration with a reputation as accepting as “The Land of the Free?”
Probably the most ridiculous part of this whole act isn't the mere introduction of it but the lack of how definitions work. With socialism and anarchy getting more popular among US citizens, terms like anarchist, radical, and now advocacy won’t stay fixed but stretch into meaning depending on who the US deems as a “threat”. This would be a violation of civil liberties and political persecution rather than legitimate law enforcement undermining democratic principles.
In conclusion, I am begging you as an individual to wake up and have a motion to reconsider an act that would repeat history, destroy families, go against our 1st amendment, and open up legal loopholes for mass deportation of citizens with clean records free of criminal charges.
