Trump risks ICC arrest warrant being issued for him, says human rights lawyer

Baroness Kennedy of the Shaws told the House of Lords that the Article 70 of the Rome Statute forbids the obstruction of justice.

Donald Trump risks an arrest warrant being issued for him after he imposed sanctions on the International Criminal Court (ICC), a top human rights lawyer has warned.

Baroness Kennedy of the Shaws, director of the International Bar Association’s Institute of Human Rights, argued that Article 70 of the Rome Statute forbids the obstruction of justice.

The Labour peer told the House of Lords that, under this law, no officer of the ICC can be impeded in carrying out their duties.

“There can be no impeding of any officer of the court in carrying out their duties, and arrest warrants can follow.”

Her comments came after the US president issued an executive order in response to what is described as “illegitimate and baseless actions targeting America and our close ally Israel”.

Lady Kennedy said: “The world will never see peace if there is no entity which will pursue justice for victims of egregious crimes. There cannot be impunity for our allies. Even now, the court is working on files to bring yet more members of Hamas to trial for the atrocities that took place on 7th October, and it is assisted in this painful work by Israeli lawyers for the families of the hostages and the families of the Israeli dead. Work continues also on the investigation of potential war crimes in Gaza. Does the Government accept that this new executive order attacks the fundamentals of the court and its functioning? And will the Government inform the United States administration, in these contracts that it has, that Article 70 of the Rome Statute forbids the obstruction of justice? There can be no impeding of any officer of the court in carrying out their duties, and arrest warrants can follow. Will the Government advise the president of the risk he faces of an arrest warrant being issued for him?”

Mr Trump signed the executive order to impose sanctions after The Hague’s investigations into Israel in its war with Hamas.

In November, judges at the ICC issued an arrest warrant for Israeli prime minister Benjamin Netanyahu and former Israeli defence minister Yoav Gallant, as well as Hamas military commander Mohammed Deif.

Lady Kennedy sat on the ICC panel which reviewed the evidence used by the prosecutor’s office to apply for warrants and helped assess whether thresholds for evidence were met.

Prosecutors then applied for the warrants and they were issued by the court.

Human rights campaigner and independent crossbench peer Lord Alton of Liverpool urged the Government to “protest in the strongest possible terms” that Lady Kennedy has been “threatened with visa restrictions and potential fines for dealing with clients who are a part of the process of the International Criminal Court”.

Responding, Foreign Office minister Lord Collins of Highbury said: “The Government has repeatedly expressed its support for the independence of the International Criminal Court, including most recently last week by joining a statement together with 70 other States Parties. Imposing sanctions against ICC officials impedes the court’s ability to carry out its important work investigating and prosecuting the most serious crimes of international concern. We are in contact with the US administration and British nationals employed by the ICC to understand the possible implications of these measures.”

He added: “Successive UK and US administrations have taken a different view on the ICC. The UK is a signatory to the Rome Statute, the US are not. The UK supports fully the independence of the ICC and we do not support sanctioning individual court officials. Our focus remains on ensuring the ceasefire can be sustained and a surge of vital aid can reach those most in need in Gaza and that all remaining hostages are released and reunited with their families. That’s our goal and we are working with the US at all levels on that and we will continue to do so.”

Former deputy High Court judge Lord Thomas of Gresford said that the forcible transfer of the population of Gaza, under Mr Trump’s plan, would be a crime against humanity under Article 7.1(d) of the Rome Statute of the ICC.

The Liberal Democrat peer added that, under Section 2 of the UK’s International Criminal Court Act 2001, the Attorney General “has no discretion but to endorse any warrant of arrest for the President issued by the ICC”.

He claimed that this would mean “no more golf for the President at Balmedie and Turnberry and certainly no more cups of tea and parades with our good King Charles”.

The UK Government has been clear that Palestinians must be allowed to return to their homes and rebuild Gaza, and that it would oppose any effort to move them to neighbouring countries against their will.

we live in a world where after idf warplanes dropped hundreds of kilograms worth of tnt, on a self designated ‘humanitarian zone’ that they demanded civilians to evacuate to, many of the medical teams who rushed there to try and save as many human lives as possible, were rescued by civilians who went to them to either help or get medical treatment, because the so called israeli ‘defense’ force targeted specifically the ambulances in another bombing shortly after, specifically to prevent them from saving lives. killing over 100 civilians, injuring hundreds more. 8 confirmed us made jdam bombs dropped in total, with estimation at a minimum of half a ton(around 1 thousand pounds) worth of tnt.

and the excuse? israel claim mohammed deif(the head of hamas’ military wing) was hiding between these civilians, even through last known appearance of him was most likely around 2018, and the one before that was in the year 2000, also there are hundreds if not thousands of underground tunnels that israel know they can’t get into, and admit they have no idea where most of them are.

hamas in response STOPPED ALL HOSTAGES NEGOTIATIONS, khalil al-hayya, (deputy chief of hamas’s political bureau) stated “we affirm that the claims of the occupation and netanyahu are false. we say to netanyahu that mohammed deif is listening to you now and mocking your false and empty statements. the claim of targeting leaders here and there is a ridiculous justification for killing women and children, and every palestinian, whether in gaza, the west bank, or anywhere else. this is an attempt by the criminal army to market its crimes against our people” he also described the attack as an attempt by the idf “to restore its dignity” after its defeat in the face of “resistance”

netanyahu admits israel have no idea if deif is alive or not and promised to go after all hamas leaders, which the idf later retracted the statement, after hamas alleged deif to be alive and well.

cheif of lebanon’s hezbollah declared this massacre will not go unpunished “the zionist enemy commits a massacre in al-mawaski, khan younis, justifying it by claiming they aimed to target hamas leaders … we will emerge victorious from the battle of the al-aqsa flood, heads held high…”

meanwhile hamas is successfully targeting and assassinating israeli combatants all over gaza.

the vast majority of israelis stopped believing in the ridiculous claims and blatant lies of the israeli government and the idf, with protests against the war, for hostage deal of everyone for everyone, and for the overthrow of netanyahu’s regime, such numbers of protests and protestors haven’t been seen since the last elections, which marked the very controversial 5th election in 4 years in israel.

lastly, the us started its sanctions against more terrorist settlers, known terrorist who organized the attacks against humanitarian trucks trying to bring food to gaza, the same attacks that standing together’s humanitarian guards stopped by physically protecting the trucks throughout their entire trip, saving as much vandalized food, and loading the saved food onto the next humanitarian trucks.

ICC issues arrest warrant for Benjamin Netanyahu for alleged Gaza war crimes

Warrants for Israeli PM and former defence minister put them at risk of detention if they go to some other countries

The international criminal court (ICC) has issued arrest warrants for the Israeli prime minister, Benjamin Netanyahu, the country’s former defence minister Yoav Gallant and the Hamas military leader Mohammed Deif for alleged war crimes relating to the Gaza war. It is the first time that leaders of a democracy and western-aligned state have been charged by the court, in the most momentous decision of its 22-year history. Netanyahu and Gallant are at risk of arrest if they travel to any of the 124 countries that signed the Rome statute establishing the court. Israel claims to have killed Deif in an airstrike in July, but the court’s pre-trial chamber said it would “continue to gather information” to confirm his death.

The chamber ruled that there were reasonable grounds to believe Netanyahu and Gallant bore criminal responsibility as co-perpetrators for “the war crime of starvation as a method of warfare; and the crimes against humanity of murder, persecution, and other inhumane acts”. The three-judge panel also said it had found reasonable grounds to believe Deif was responsible for crimes against humanity and war crimes including murder, torture, rape and hostage taking relating to the Hamas attack on Israel on 7 October 2023 in which fighters killed more than 1,200 people, mostly Israeli civilians, and kidnapped 250. Netanyahu’s office denounced the chamber’s decision as “antisemitic”. “Israel utterly rejects the false and absurd charges of the international criminal court, a biased and discriminatory political body,” the office said in a statement, adding that “no war is more just than the war Israel has been waging in Gaza”. The statement pointed to an investigation into accusations of sexual misconduct against the ICC prosecutor Karim Khan who sought the charges against the three men in May. Khan, 54, has denied the allegations and said he will cooperate with the investigation.

The US national security council issued a statement “fundamentally” rejecting the court’s decision. “We remain deeply concerned by the prosecutor’s rush to seek arrest warrants and the troubling process errors that led to this decision,” the statement said, without any detail of the alleged errors. “The United States has been clear that the ICC does not have jurisdiction over this matter. In coordination with partners, including Israel, we are discussing next steps.” The US has previously welcomed ICC war crimes warrants against Vladimir Putin and other Russian officials for atrocities committed in Ukraine, exposing the Biden administration to accusations of double standards from many UN members, particularly from the global south.

Netanyahu can expect more resounding support from the incoming Donald Trump administration. During his first term, in 2020, Trump imposed US sanctions on the ICC, aimed at court officials and their families. The then secretary of state, Mike Pompeo, made clear the sanctions were imposed because the ICC had begun investigating the actions of the US and its allies in Afghanistan, as well as Israeli military operations in the occupied territories. The panel said the full version of the warrants against Netanyahu and Gallant were secret “in order to protect witnesses and to safeguard the conduct of the investigations”, but the judges released much of their reasoning. This focused on the obstruction of the supply of humanitarian aid into Gaza, which it judged to be deliberate.

The ICC has issued arrest warrants for genocidal maniacs Israel PM Benjamin Netanayhu, former defense minister Yoav Gallant, and Hamas’s military leader Mohammed Deif.
