Rep. Bennie Thompson Is Suing Trump For Conspiring To Incite The Capitol Insurrection

Thompson, a Mississippi Democrat, filed a claim under the Ku Klux Klan Act against Donald Trump, Rudy Giuliani, the Proud Boys, and the Oath Keepers.

Trump and Giuliani are being sued by Rep. Bennie Thompson (D-MS-02) and the NAACP for instigating the US Capitol insurrection. They are taking a novel approach in their lawsuit.

Rep. Bennie Thompson, a Democrat from Mississippi, is pressing a claim under what's known as the Ku Klux Klan Act, a Reconstruction-era law that includes a section that makes it illegal to conspire to prevent public officials from "discharging any duties." Thompson is alleging that Trump and Giuliani incited the mob that descended on the Capitol to prevent Congress from certifying the Electoral College vote, while leaders of the Proud Boys and Oath Keepers "acted in concert to spearhead the assault."

Using a Reconstruction-era civil rights law, the door is left open to various suits under more recent laws. In other words, this will be far from the last lawsuit Trump will face over his behavior while in office.

Also, using a Reconstruction-era law is a way of pointing out that the work of Reconstruction was abandoned without being completed. Just as there was an effort at denazification in Germany after World War II, an overdue deconfederatization is needed in the US. Being a white middle-aged male does not exempt anybody from laws on terrorism. True law enforcement does not play favorites.
