Retrial ordered for Indonesian Christian charged with khalwat
GEORGE TOWN, June 19:
A khalwat case involving an Indonesian Christian woman here three years ago that was dismissed by the Syariah Court of Appeal early this month, will now be retried.
The Syariah Appeal Court had apparently ruled so in Chambers on June 5 when it struck off both the appeal against the decision and the conviction while calling for a retrial of the case.
Halimah, 42, was charged with close proximity with a person of the opposite gender who was not her spouse or relative, an offence under Islamic law and enforceable exclusively on Muslims.
“The retrial date is yet to be set so we will try to find out from the prosecution,” said Wan Faridulhadi Mohamed Yusof, who acts fof Halimah.
Wan Faridulhadi, who appeared unaware of the decision until today, said the prosecution would be requesting for a date for the retrial of the case.
“A retrial of the case means she will be able to present to the court that she is not Muslim, but a Christian.”
He added this time, the charge against Halimah would be read out in full and translated for her so that she could understand it.
Halimah was convicted of committing khalwat at a reflexology centre along Jalan Seang Teik at 11.40am on Dec 8, 2011.
The reflexologist, who was born a Christian and had never converted to Islam, had unknowingly pleaded guilty to the charge before the Penang Syariah Court on May 15, 2012.
She had pleaded guilty due to confusion over the offence as she was not represented at that time and also due to language problems.
She was subsequently sentenced to jail for 14 months and fined RM3,000, but was allowed a stay of execution pending an appeal.
Wan Faridulhadi submitted her appeal to the Penang Syariah High Court, but the lower court decision was upheld so they submitted another appeal to the Syariah Court of Appeal.
In his submissions, it was mentioned that Halimah was a Christian and therefore should not have been charged in the Syariah Court as it had no locus standi over non-Muslims.
The case had been pending in the Appeals Court since March 18 when Wan Faridulhadi filed an application to quash Halimah’s conviction.
The application was made under Section 74 of Penang Islamic Religious Administration Enactment 2004 stating that the court had no jurisdiction over non-Muslims.
The documents submitted included her baptism certificate, a confirmation from the Indonesian Embassy of Halimah’s Christianity and also a family charter that showed all her family members as Christians.
The Indonesian Consul General Ronald P. Manik had written to the Syariah Court of Appeal to request for updates on the progress of the case in April.
Manik emphasised that Halimah was a Catholic and did not fall under the Syariah court’s jurisdiction.
