SEBI’s TAC proved wrong!

The TAC or Technical Advisory Committee is mostly appointed by Indian securities market SEBI and has nailed the wrongdoing in the controversial news related to NSE, as mentioned by E&Y in the revised report. The committee also rapped the findings of E&Y for the failure of the forensic firm to draw some conclusions associated with the NSE co-location scam.

This meeting was held in the year 2018 June. In this meeting, TAC pointed out how in 2014 some of the brokers were allowed to log into co-location consistently and into the servers ahead of others. This segment led to the breakdown in the system and further processing lack at NSE.

Examine the architecture of NSE:

The first point was associated with the examination of whether the NSE’s TBT data dissemination architecture was prone to the alleged market abuse and manipulation.

Understanding preferential access:

The meeting further determines whether some of the members were actually given the access to the backup servers and did this give undue advantage to them. It was noted by the committee that E&Y observed that NSE did not give any defined policies for secondary server access and did not have any documented procedure or policy for reprimanding members connecting to the secondary servers.

NSE Co-location Issue : NSE Submits E&Y Reports To SEBI

It was right at the starting of 2018 in the month of January, when the National Stock Exchange submitted the forensic audit report on one fine Tuesday. The report was mainly associated with the co-location issue and it was part of the NSE colocation scam. This report was freshly prepared at that time by forensic auditors E&Y and presented to SEBI.

E&Y in its forensic audit report stated that there was no way a member can gain materially with help of preferential access.

Resignations at NSE Following the NSE Colocation Scam

It was by The Economic Times, which first reported that on 22nd May 2017, SEBI came up with the show cause notices to the exchange and even to 14 individuals, which included the former managing directors as well, namely the Ravi Narain and Chitra Ramakrishna.

They were known to be a part of the NSE co-location allegations. Notices were sent to Ravi Narain, who was the vice chairman and CEO of the exchange at the time when the alleged violations were first notified.

Other names as involved:

Apart from the main two names as mentioned, some of the other names of the officials included in this section were Ravi Varanasi, who was chief of the business development department of NSE and was also leading the surveillance department of said exchange at this point of time.

Then you have Suprabhat Lala, who was the regulation chief and further the head of trading division during the period of 2010 and 2013.

Some of the other officials in this regard who received such show cause notices were former technology heads namely Umesh Jain and Ravi Apte. Then you have the former CEO Subramanian Anand.

The vice chairman of NSE, Ravi Narain has stated in papers on 2nd June 2017 amid the regulators intensifying the probe into lapses in the said high frequency trading.

In the year 2016 December, the MD and CEO Chitra Ramakrishna resigned. According to the media reports, Chitra’s resignation was mainly the result of two government related issues at NSE. One was mainly the loss of confidence in top NSE management because of the NSE colocation controversy. And another reason was the controversy revolving around high ranking NSE official Anand Subramanian, who resigned on 1st April 2015 as Group Operating Officer and Advisor to MD.

This appointment mainly took place after the communication from MD, NSE and EO offices bypassing the HR department. Some of the complaints regarding such appointments along with the high salary package of Subramanian reached broad promoting it to further examine the appointment based procedure in this regard. This stage later led to the resignation of Subramanian from office at October 2016. Both of them were major structural founders of the NSE team.

After the cause notices:

Upon receiving the SEBI’s show cause notice, around 12 out of 14 high profile former and current executives of the NSE, along with Chitra Ramakrishna and Ravi Narain filed application with SEBI. The application was talking about the settlement of the NSE colocation issue in July 2017 under consent mechanism. This is a procedure of alternative dispute resolution, allowing the wrongdoer to settle pending issue by accepting penal action without denying or admitting the guilt.

At this point, Vikram Limaye took charge as CEO and MD of NSE. He provided assurances that he will be the one approaching SEBI for settlement of NSE colocation and find underlying cause behind it. But, a consent application was later returned in March 2018 after CBI came into force.

It was in the year 2010 January when NSE first started offering the intelligent co-location facility to the members, which is the beginning of the NSE colocation facility.

Colocation is the facility where the members are given the chance to place their servers in premises of the exchange in return for a selected fee.

This gave them the opportunity to access faster for buying and selling orders after being disseminated by the trading engine of the exchange.

Co-location actually means a proficient setup where the broker’s computer is mainly located in same area as the server of the stock exchange.

Even the retail investors were given the chance to monitor prices as subject to delay when compared to tick by tick data broadcast, which otherwise the user receives in any of the co-location facility.
