Little bit of info about McFall vs Shimp (also known as “Why abortion will likely remain legal whether or not you like it.”)
McFall versus Shimp happened in Pennsylvania in 1978. This guy named Bob McFall was dying. He had aplastic anemia and was circling the drain. If he didn’t get a bone marrow transplant, he would surely die. Well, Bob had a cousin named Dave. He was the only viable option for a successful transplant, but he didn’t want to give of his body to save anyone. Even his cousin Bob. They went to court. The judge found in favor of Dave. Because he didn’t think it would uphold the law of the land to force someone to give of their body, even if it meant Bob would die. Bob died. Now, since then, that case has been cited every. single. time someone has taken someone to court to try and fight for the right to use their body even though the other person has said no. The United State Supreme Court has upheld that no one has to give of their body to keep another alive. Regardless of circumstances, no one has been forced to give of their body to save another. They’ve used the 4th and 14th amendments to continue to guarantee a person’s right to their body granted to them upon birth. When people try to make the decisions for others based on their beliefs, people like Savita Halappanavar, Angela Carder.. in the case In re Klein, a guy had to fight to get his wife the aggressive treatment she needed to survive (she was in a coma) and had to fight against “prolifers” to save HER life over that of the fetus. In Curran v. Bosze, a mother didn’t want her twins to give bone marrow to save their brother. Their father wanted them to, the Illinois court said,”Nope. Do not pass go, do not collect $200.” Long story short? Even if someone will die as a direct result of your action (even if that action is INACTION) you are not obligated to give of your body for any reason to save the life of another. A fetus is not above the law. If you think it’s equal, then it needs to follow the law as equally as the rest of us. None of us can use someone’s body to keep us healthy and alive without their willing, continued consent. And that’s the law of the land.

Yes…but if I take part in potentially risky behavior, I take upon myself the risk of the consequences of those actions. You see, Dave did nothing to cause Bob’s need of his bone marrow. Actions of Dave didn’t cause Bob to exist in the first place, either. In a normal pregnancy, there were quite energetic activities that brought about the life of that child. If a woman has consensual sex, she takes upon herself the risk of pregnancy. By having consensual sex, the woman consented to the potential consequences, which may include bearing a new life to term. The difference between the two is as if Dave consented to the surgery but then changed his mind and wanted to kill Bob by slicing open his face to harvest the brain or by chopping him into multiple pieces after the surgery was done, because the fact of Bob’s life was no longer *convenient* to Dave. Consensual sex EQUALS consent to consequences of sex. By undertaking an action you consent to the consequences of that action.

From the standpoint of evolution the purpose of vaginal intercourse, the entire reason for the wrinkley bits to exist, you shithead, is for procreation. Everything else is a side effect of evolution designed specifically to make procreation and childrearing more likely.
Pregnancy is not a punishment for sex any more than acting recklessly on a stairwell with a skateboard and falling is somehow a punishment. IT IS A CONSEQUENCE. Not only, you shithead, is it a likely consequence, if the two people engaging in sex are both healthy and capable of reproduction, you shithead, it is a PROBABLE consequence if the correct safeguards are not in place.
Injured people in the ER for acting stupid with bottlerockets and M80s are not being punished somehow. They are enduring the consequences of stupid behavior.
If you don’t want to have a baby with the partner you are having sex with, you shithead, rent a copy of the kama sutra on Netflix or queue up some internet videos on responsible adult sexuality and find a sex act that won’t result in pregnancy that satisfies everyone in the room. This is not complicated.
And if you weren’t such a rigorous asshole you might have fun with it.
Even if Dave had somehow caused Bob’s cancer, Dave still would not be legally required to have his marrow forcibly taken. As another example, I hit someone with my car because I drove recklessly, and caused a lung or kidney or something-a-living-person-can-donate to rupture. While I may certainly be morally required to donate the part of my body I fucked up, given it was my fault, a direct consequence of my action, etc, it would not be ethical of the legal system to strap me down and give the person I hit one of my kidneys or lungs, even if said person’s life depended on it. So even if you think consent to sex = consent to pregnancy, that still doesn’t erase bodily autonomy.
That is right. Consent to sex = consent to pregnancy. In this unique and unassailable instance, a person has come into being, has started to exist, because of the actions of two other people. Those other people went to some effort to go through the activities that caused that person to come into being.
That person did not ask to be conceived. That person did not ask those two people to go through sweaty naked exertions to have vaginal intercourse. That person has no capability to give consent to either the sex that started their existence or the murderous surgery that you advocate using to end their existence.
So….logically, since the new life that was started and is existing in the womb of that woman is there (except in the numerically comparatively rare instance of rape) because of that man and woman’s direct and willing actions that she and he had some knowledge would create that life, that child is their direct responsibility.
You are directly advocating killing a pure and completely innocent person who has come to be in a situation that they have absolutely no control over because of the direct, willing, and complicit actions of the woman (and a man) you are trying to draw a picture of as a victim.
That new life, that baby, is not victimizing that woman. That woman will be victimizing that new life, that little innocent baby, by killing it out of convenience.
That baby has bodily autonomy just as much as the mother does. There is no caveat to the concept of bodily autonomy that it only includes women who have had sex with the wrong man and gotten pregnant. And that baby did not run and jump into that woman’s uterus. That woman (except in the instance of rape) went through some pretty specific and pretty energetic activity to CAUSE that child to exist.
…okay, so this matter obviously isn’t going to be resolved in any meaningful or agreeable way. However, out of curiosity, given your emphasis on consent, do you then think a woman pregnant because of rape does then have the right to abort?
There is compelling evidence that the victims of rape that become pregnant may suffer mental or even physical maladies from bearing that child to term. I understand this. But I advocate for the child as well.
I believe that the baby involved did not rape that woman. I believe that the responsibility for the child that resulted from rape is entirely that of the rapist, but there is no useful way at this time of forcing the rapist to carry the child to term and shoulder the responsibility of raising that child.
If there was a useful method for doing so I would campaign with no compunctions whatsoever to force the rapist to undergo a sex change and bear that child to term in the place of the victim of the rape. It is 100 percent that rapist’s responsibility.
Given that prophylactic termination is routinely given in the cases of rape and sexual assault at American hospitals (in the form of the Plan B morning after pill) this question is probably moot. In fact a number of states have passed laws *requiring* the introduction of the Plan B pill to women who have suffered sexual assault.
But, if you really want my opinion on the matter, the baby did not do anything wrong. The baby did not rape the mother. The baby does not bear any onus over what the rapist did.
There are wonderful and inspiring biographies available of strong women who raised children who were the product of rape and how joyous they are with their child and how happy those childrens’ lives have turned out to be.
This is entirely the crux of the matter. You fail to keep in mind that there were three people involved in the conception. The sperm donor, the egg donor (willing or unwilling), and the resulting child. If your logic and your reasoning doesn’t include the welfare and well being of the innocent child that didn’t ask to be conceived and had no consent to his or her implantation in the womb of the woman, your logic and your reasoning are incomplete.
I personally don’t believe that my beliefs should be forced upon other people through legislation. I fight online about these topics because there are people who are not telling the truth about a lot of topics and these people are deliberately misleading people for their own gain or to further som e ridiculous political agenda.
I studied propaganda in college and I pursue the concepts now as a hobby. Many of the ‘facts’ that are bitterly clung to by pro-choice advocates started off as propaganda that has taken on a life of its own. One good example is the clothes-hanger myth. Before abortions were legal, they were performed by doctors for pay in the US. Percentages of abortions actually conducted in a 'back alley’ with substandard equipment or a coat hanger were vanishingly small then and are vanishingly small now. But the image of some woman being poked with a bent clothes hanger by some snidely whiplash persona in a back alley is the big bogeyman of the abortion debate. It is a false doctrine, but it is clung to bitterly by people who want the legal right to kill children at a whim.
I have met women who aborted their children out of fear or because their parents or (God forbid) some asshole boyfriend forced them to. Some of these women never regretted that choice. Some did. Some wake up at night and think they hear a child’s voice in the next room. Some have even asked me what I thought the child would have looked like or whether I thought it would be a boy or a girl.
I would not pass a law forbidding people from pursuing abortion. I believe that people have the right to march their way into heaven or hell all on their own recognizance. I *WOULD* make damn sure they know the entire truth about the procedure they would undertake and I would make damn sure that the information they get does not *only* come from some company that makes a profit from instituting the sale of umbilical cords and body parts from the abortions they provide. I would also make sure to point out to people that poor and minority people are overwhelmingly the ones getting abortions, so there may be a hidden agenda in some political party telling you it is ok to kill that child….they may want to have you induce your own genocide or shrink the population of your particular demographic for some political purpose.

The way they talk about it, you’d think anti-choicers believe that pregnancy is the only consequence of sex. There are multiple things that can happen with sex, STD/STIs, infections, etc. But here’s the real kicker about those things: you can still get access to healthcare for them even if you were aware that they could happen if you have sex.
So why should pregnancy be the only ‘consequence’ of sex that doesn’t get medical treatment?
