Term of notice employers' and salaried employees' act

Every employer and employee in Denmark should obey the term of notice employers' and salaried employees' act (in Danish funktionærloven) and it is quite an important act that cannot be ignored at any cost. The act was issued back in 1996 and here is a brief explanation of its content which concerns the employees and employers that reside within the borders of Denmark:

- The contract between the salaried employee and the employer cannot be terminated by any of the two parties unless there is a prior notice given. However, there are certain rules for that and from the side of the employer, as per the term of notice employers' and salaried employees' act, the termination of the contract of employment should be at least with a one month’s notice in case the employee is in their first six months of employment. In case the employee has been employed for over six months, the notice should happen at least three months in advance. Also, for every three additional years after the first six months that the employee works for the employer, the notice period should be increased by one additional month. These additional months cannot exceed six and that is the maximum period to receive a notice for termination of the employment contract. There is also an exception to that rule and it can happen when both the parties agree that the work is temporary and the relationship of the employment won’t exceed more than three months. However, a proof for that agreement should be presented by the employer in order to not apply this rule. Also, if the employer has a proof of agreement between them and the employee that the employment will be probation and it won’t exceed three months then the shortest period for a notice for termination of the contract is two weeks.

- From the side of the employee, a termination of the contract notice should be given within a period of at least one month before termination of the contract, as stipulated in the term of notice employers' and salaried employees' act. This rule does not apply for probation works as well as work that does not exceed three months. However, there is the option for the employee to have an agreement with their employer to increase the notice period from both sides accordingly. This means that you can add a few months to the shortest notice period from the side of the employee in case the employer agrees to it and provides an equal increase in the minimum notice time. In case the enterprise changes its owners and a certain employee continues to work in it, all the years that they have in the previous enterprise will be accounted for by the new owners. In case the enterprise provides the employee and their family with residential accommodations then the period of notice from the side of the employer should be three months minimum. Also, the employee will be enabled to continue residing in the dwelling with their family for up to one month after their contract is terminated.
