Since I didnât put anything on this blog for a few weeks, I thought I could post this sketch of Galaere, my engi. Itâs been one or two weeks since Iâve finish it, but I didnât have time to post it, so there it is! I got the inspiration to draw this after playing PoF with this character. It was a lot of fun! ok tumblr, you seem interested in political activism, so weâre going to have a little lesson in administrative law and how you can force the Trump administration to listen to you for the next four years.Â
To condense a semester-long law school course into a blog post: Congress delegates significant quasi-legislative power to administrative agencies, e.g. the EPA. These agencies have a great deal of power to shape your everyday life, but our system of civics education is so abysmal that, chances are, you have no idea what kind of power you hold to shape their decisions.
Administrative agencies have to navigate a maze of laws and procedures in order for the rules they make to be effective and binding. These laws and procedures mean that there plenty of ways the agencies can mess up, and when they do, opponents of a rule can bring legal challenges and invalidate it. (This is frustrating for agencies, but delightfully fun for antagonistic nerds like me.)
When an agency wants to create an informal rule, it has to go through a process called ânotice and comment.â Basically, the agency announces a proposed rule and permits the public to submit comments on it. The public includes you.Â
When the comment period is over, the agency has to take the comments into account and justify its ultimate decision on the proposed rule in light of the comments. If you submit substantive, meaningful comments that challenge the policy or evidence behind a rule, and the agency fails to acknowledge them and explain its reasoning for its final decision, the rule can be challenged and invalidated.
So how do you comment on proposed rules? This lovely little site called regulations.gov. Really, itâs that easy! You can search for topics that interest you and submit your comments online. And you can do it anonymously!Â
So please, check the website frequently and comment when it matters to you, so that your voice can be heard and Trumpâs agencies have to acknowledge your perspective. If they fail to take your comments into consideration and disregard the American people, theyâll have to answer for it in court.
Keep calling your representatives and senators about Bannon and the policy issues that concern you, but remember this little lesson in admin law when he takes office.

Trump recently announced his intent to slow, if not halt, the creation of any new regulations when he takes office. Can he do that? As any lawyer would answer: it depends.
Should he succeed, it becomes even more important for you to make your voice heard. Some agencies have a statutory imperative to regulate under certain circumstances. There is precedent for challenging an agencyâs refusal to act; look up Massachusetts v. EPA, 549 U.S. 497 (2007). That case could not have happened without people and organizations petitioning the EPA to act on climate change; the petitions compelled the EPA to acknowledge that it was refusing to act and justify its reasoning (which was ultimately found inadequate by the Supreme Court).
A few people commented on this post saying that we would be wasting our time by submitting comments or petitioning the agencies. I understand that frustration; I, too, have felt powerless at times in the wake of this election. But that is how Trump and Republicans want their opposition to feel. A person wiser than me described it as âObeying before you are asked.â

My original post was intended to suggest one more small way we can reclaim some semblance of power as citizens, and set the stage for lawyers to utilize the courts as needed to shield people from someone who has given every indication that he will abuse his power. Maybe I should clarify something: my experience with Neo-Nazis is not, in fact, limited to the internet.
I happen to have been raised around several white men and women who spent a good chunk of their adult lives in prison. Many of them joined white supremacist gangs during this time. They raised their kids -my friends at that time- to be white supremacists. They had swastikas hanging in their living rooms and would talk openly about beating up or killing racial minorities (but ofc they said slurs instead). I didnt say anything at the the because I was 11-13 years old and didnât really know any better; and these men scared me. This is a meth town in Texas, where itâs expected everyone owns a gun and is ready to use it- I once saw one of them beat the shit out of a 16yo and shove a shotgun in his face.
So thatâs what I think when I think âNeo-Nazisâ, not these âalt rightâ pussies. So I know that they -and their kids- were still capable of spending time with nonwhite people and pretending to see them as humans, and then talk about how âthe South would rise againâ and they would âown them n*****sâ and other shit I donât care to remember.
And let me tell you: no amount of calm, rational discussion will sway these people. Ever. If you were to challenge their views they would eventually resort to violence to shut you up; if you tried to ârise aboveâ all that would happen is theyâd laugh you down and call you a pussy and continue believing, speaking, and yes, acting on their beliefs.
When I say âpeaceful resistance wonât stop Neo-Nazisâ itâs not just a philosophy I read in some book. Itâs my lived experience.
