Drawing porn of child characters from comics or cartoons is ILLEGAL in the United States

18 U.S. Code § 1466A - Obscene visual representations of the sexual abuse of children

(a)In General.—Any person who, in a circumstance described in subsection (d), knowingly produces, distributes, receives, or possesses with intent to distribute, a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting, that—

(1)

(A) depicts a minor engaging in sexually explicit conduct; and

(B) is obscene; or

(2)

(A) depicts an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex; and

(B) lacks serious literary, artistic, political, or scientific value; or attempts or conspires to do so, shall be subject to the penalties provided in section 2252A(b)(1), including the penalties provided for cases involving a prior conviction.

(b)Additional Offenses.—Any person who, in a circumstance described in subsection (d), knowingly possesses a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting, that—

(1)

(A) depicts a minor engaging in sexually explicit conduct; and

(B) is obscene; or

(2)

(A) depicts an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex; and

(B) lacks serious literary, artistic, political, or scientific value; or attempts or conspires to do so, shall be subject to the penalties provided in section 2252A(b)(2), including the penalties provided for cases involving a prior conviction.

Here are some recent cases and convictions.

Most recent conviction seems to be May 2016. That’s this month.

When abusive adults in fandoms prey on the children in them, try to spread that it’s okay to draw child porn of the child characters, to sexualize the child characters, they are breaking the law and encouraging minors to break the law. The law doesn’t care if you use it as a “coping mechanism” (even forgetting that abused people can become abusers themselves). This is illegal and it can get you imprisoned.

Please boost this. Not enough people know the law exists and big-name artists routinely bully people, survivors, minors into believing that spreading child porn in their fandoms is okay and to do it themselves. It’s not, and it can get rebloggers arrested for possessing and spreading obscene visual representations of the sexual abuse of children.

Addenum since a reblogger tried to argue that child porn had serious artistic value and therefor didn’t apply under this law. The “ lacks serious literary, artistic, political, or scientific value; “ section refers to porn for the sake of porn but excludes things like the anti-CSA advertisements where a naked child was covered in hands, and the ads implied how damaging CSA was for the children. That has serious artistic and political value. Porn for the sake of porn does not.

That would be excluded under this law, but porn for the sake of porn would not be. For example, the people convicted of this law under the recent cases were convicted while possessing shota/loli porn (animated porn of children) and comics of a teacher performing sexual acts on a child, for example, and other sexual drawings of children. Because all of that lacks serious value and is porn for the sake of porn for the sole purpose of getting off pedophiles.

If the child porn is made for the purpose of getting off to or being “sexy” or “titillating” for its intended audience (pedophiles), that is convict-able under this law.

The way fandoms romanticize, sexualize, and fetishize rape, pedophilia and incest is scary and infuriating.

They’re all “oh ship what you want uwuwu draw what you want uwu write what you want uwu”. people are drawing child porn? they’re all, “that’s artistic creativity uwu” (illegal in the US btw even in in fiction depictions of fictional characters and you can go here for recent criminal cases about it)

People who’ve been victims of these things and don’t like how it’s romanticized and fetishized? They’re told “You’re stupid beyond words, you can’t tell the difference between reality and fiction, stop telling me I can’t jerk off to child rape fics uwu”

And it’s fucking infuriating. Guess who reads fiction? Guess who looks at art? Real people. Guess who feels validated by the rabid fetishizing of rape/pedophilia/incest? Guess who feels demeaned by it?

How come we can agree that rape jokes are bad - which demean the victim and validate any listening abusers - but some people think that things that actively romanticize and fetishize these things are A-okay?

How can we agree that 50 Shades and Twilight are harmful to readers, especially youth (and yes, youth will often read things that are explicit, surprise) because they romanticize domestic abuse, but somehow some people think fiction that romanticizes pedophilia, rape, incest, etc, are A-okay?

And by the way, this isn’t about simply including those topics. Like what happened in Tokyo Ghoul recently, in which the attack was treated as obviously horrifying, traumatic, and harmful, was not done for shock value, was not sexualized in the slightest, and the narrative made it obvious that the acts were condemnable and evil. No abuser could leave the chapter feeling validated (it was, I feel, very much an attack on abusers and the damage they do). That’s how it should be done if these topics are brought up in fiction/art.

When these topics are treated as right and romantic and done for the sexual pleasure, that’s wrong. The authors of 50 Shades and Twilight would probably say, “oh…domestic abuse is wrong…yeah” but there they are anyway, romanticizing domestic abuse and treating it as okay, and the readers are learning from it even though they know it’s fiction, because the people in their circle approves of the work. What’s the difference?

Pedophilia is not a fetish. Rape is not a fetish. Incest is not a fetish. They’re crimes, and romanticizing, sexualizing, and fetishizing them is harmful and wrong and there are cases in which drawn or fictional works have been used by abusers to show to their victims, particularly children, to justify and encourage their abuse, as well as to validate themselves, and invalidate their victims.

And this attack culture, of attacking victims, is wrong. There’s a post with thousands of notes calling victims “stupid beyond words” for “not being able to tell the difference between fiction and reality uwu”. Just like Twilight/50 Shades is harmful, just like rape jokes are harmful, romanticizing, sexualizing, and fetishizing pedophilia/incest/rape is harmful and so is the culture that comes with it.

Child abuse in Japan

While no link has been made between anime, manga and child abuse, Japan is facing a “serious” child abuse problem, according to a White Paper issued by the National Police Agency in March.

The paper said the number of child abuse victims jumped 20% between 2011 and 2012, and the number of victims, arrests and cases are at their highest levels since they started compiling statistics in 1999.

At the same time, the number of cleared child pornography crime cases rose to 1,596, the highest ever recorded, the paper said. Most – 85% – were Internet-related. The figures inspired the U.S. State Department to label Japan as an “international hub” for producing and trafficking child pornography.

The U.S. report noted that no national law addresses the “unfettered availability of sexual explicit cartoons, comics and video games, some of which depicted scenes of violent sexual abuse and the rape of children.

It added: ‘While the NPA continued to maintain that no link was established between these animated images and child victimization, other experts suggested children are harmed by a culture that appears to accept child sexual abuse.”

This needs to be fucking slam-dunked in the faces of every single abhorrent and disgusting pedophile and/or pedo-apologist that wants to cry and whine about how fictitious child pornography doesn’t contribute to nor perpetuate CSA just as real footage or photographs of children does; those disgusting clods who insist that fictitious depictions of children in sexual situations doesn’t somehow normalize the idea that sexualizing children is okay, and that it doesn’t ~actually~ harm anyone… as if this form of child pornography exists in a vacuum.

Lolicon and Shotacon are child pornography. They hurt children in Japan, and most likely children in other various places world-wide where this type of child pornography spreads. Why? Because child pornography is child pornography, plain and simple, and every last bit of it is toxic and harmful… and this particular variety only makes it easier for pedophiles to victimize children due to its “appealing” style, so don’t you dare ever say that it’s somehow more acceptable for child pornography to exist and that it’s somehow not harmful - all because it’s DRAWN.
