Gov Whitmer has signed historic legislation. The way it’s written - if you have benefitted from rehabilitative services you are eligible. Lots of OWI bills were introduced and one interesting bill that was passed RAISES the legal presumption to .10 … but only if the USDOT ends the practice of tie-barring MILLIONS of road funding to a .08. No .08 = no scratch for every state in the union. A bill that didn’t get passed was the bi-annual sunset extension! As a compromise 20 years ago - the drafters of the then-controversial .08 bill was given a sunset so that we reverted to .10 every odd year of the sunset on .08 was not extended. Prepare for your jaw to drop if you are a DUI lawyer - The Michigan State Police forensic science team will no longer testify about conversion of a serum blood ethanol analysis to a whole blood value. Yes: that means a blood drawn for medical purposes ain’t getting admitted folks. That is unless a prosecutor out there tries to get an expert to whore themselves out. Big news.
