There are a few states that actually have Shield/Refuge laws designed to help trans people fleeing from trans-unsafe states, which also guarantee trans folks access to healthcare. These states are:

California

Colorado

Illinois

Oregon

Vermont

Washington

Minnesota

New Mexico

Maine

Massachusetts

Rhode Island

Connecticut

Washington D.C.

Additionally, some states have "trans sanctuary" executive orders signifying safety for trans folks seeking healthcare. These states are:

Maryland

New Jersey

New York

Living as a resident in these states means you are protected by state's rights and state government to continue or begin receiving trans healthcare. These laws have been codified in their states so everything has been a-ok'd by their state governments.

Trans people in texas please be careful right now. This is terrifying and not okay at all.

Please share so people are aware of this. I can't imagine how horrible it would be to show up to make this change, thinking you have legal court approval, and you get not only turned away but put on a register for it. Who knows how they'll try to use it against you in the future.

"This can't be legal" it doesn't matter. The system is so deeply transphobic that they can basically do whatever they want. What are you going to do, call the cops? They don't give a shit. Civil matter.

It could take a bunch of people suing until they get a judge that isn't absolute dogshit for this to change, and meanwhile it'll be months of even years of trans people in texas being unable to get ID that matches their gender, and being put on a register if they try. And that's the best case scenario. Who knows how much worse it could get.

They are doing this because the Texas Attorney General requested records of people who had their gender marker changed already. They couldn't give those records because they included not only trans people, but people who had it changed due to clerical errors. This is an attempt to create a database that does only include trans people. I'm sure I don't have to explain why that's terrifying.

Gipson wrote, “If a first-time applicant presents conflicting documents, such as a birth certificate with a court order requiring a sex change, the sex listed on the original birth certificate will take precedence to record the sex. If a single court order contains both a name change and a sex change, we cannot accept the order. The applicant will be processed with no change and with the information on file.”

Gipson then directs employees to scan into the record all “court order sex change documentation that cannot be processed” and email the requesting person’s name and driver’s license or state ID number to “[email protected],” noting on the email subject line “Sex Change Court Order.” Adding that changes due to clerical errors are not to be reported and that the DLCourtorders email is “for internal reporting only and should not be shared with customers.”

Wow, it's so unfortunate that the article lists the email address and necessary subject line for reporting trans Texans. Wildly irresponsible journalism to leak the internal email address like that. I hope the inbox doesn't get inundated with false reports and spam.

Know it’s because I’m using my connections to a sibling who is an ADA in NYC to get some pretty high powered representation to tell the state of Texas to go fuck themselves.

But yeah… $900 an hour isn’t exactly an amount that the average trans Texan has around, and that is what they are counting on. And not everyone knows how or has the connections I do to get pro bono counsel.

But literally, the State of Texas is going to rue the day they pissed me and my family off. We’re pedantic, unrelenting, and from a long line of lawyers and political activists. I will take this all the way to the top if I have to.
