The Government of Indonesia is currently in the period drafting the Draft of Criminal Code. However, the current Criminal Code Draft has the potential to criminalize and discriminate all of us as citizens, primarily the marginalized, poor, children and women.
Recently, Indonesia’s House of Representatives (Dewan Perwakilan Rakyat) and the Government is reported to approve to continue to expand the draft on criminal acts of adultery in the current Criminal Code.
The current Draft of Criminal Code has the power to punish the poor because most of them have no documents of marriage legality. The phrase “legitimate marriage” to prove the validity of a “husband and wife” relationship will result in millions of married couples with no archived evidence of marriage and their children becoming victims.
Victims of rape will be prosecuted for committing adultery outside of marriage. Surely this is not fair and will cause a very heavy injustice polemic against the victim.
Criminalizing sexual relations outside of legitimate marriage bonds has the potential to increase the marriage rate of children because being unmarried becomes more risky and criminally detrimental than married. This has the potential to increase the rate of marriage of children (with the status quo of 25% of married underage girls in Indonesia).
In this case, it will certainly increase more groups of people who will race the race to become the ‘moral police’ and interfere with the privacy of others. House raids, boarding houses, apartments and other privacy rooms will be more prevalent if this draft is legalized.
Not only that, the current Draft of Criminal Code also criminalize girls more than boys, because it provides criminal penalties on extramarital sex, girls who experience unwanted pregnancies or require reproductive and curative reproductive health services may be subject to imprisonment.
In addition, there is a matter of special protection that is conditional only for the “good kids” which means it will only be valid for children who is “not married” in some cases.
The draft also hampered the 12-year education program because marriage will increasingly be perceived as a rational choice to avoid imprisonment due to extramarital sex behavior. In fact, once married, the children, especially girls, they tend to leave school.
I’m here to ask all of you, especially fellow radical feminists, even some of you out there who calls yourself a feminist or simply those who’re aware of injustice, to help me, hand-in-hand, help us by signing the petition in refusing this regulation to be legalized.
