I got cocky….. I almost got caught at EarthBounds and Uffda. She was suspicious luckily no cameras in the store and I got out fast. Lmao I told my friends parents I didn’t feel so good and I left 😂, not gonna see me anytime soon. She kept asking for my bag and guys you have the right to say “ No” I said that with a smile 💕💕, and I fucking left. I tired to say it as sweetly as I could and I left and she asked where I put the stuff and I told her and she called someone I think when I left and I went and I almost threw up but I didn’t 😂💕! I’m so lucky.
I got cocky by you always have the right to say “ No” because she’s not LP she is a SA therefore she has no right. I used it and thank god Ik my rights then and there and I wasn’t being to nervous and didn’t do something stupid. Just say “ No” and walk out and don’t look back. Also take a deep because you did it! Good job!
Lp don’t have the right to look into your bag either! Only actual police can go through your personal belongings legally.
I just made a post about this, but you’re sort of wrong. I’m not trying to start anything here, but please just consider for a second. The fourth amendment protects you from the government searching you without reason, not private citizens. So if they forcefully do it, yes it could be admissible evidence, but you would still have a case on your hands. In some stores they do in fact have the legal right to search your bag. If it was part of the ‘contract’ of you entering the store, such as Costco or stores with signs, then they can in fact search you as they told you it was a contingency to shop there.
Also, stores are legally permitted to detain you under reasonable suspicion, which sadly is not defined by law. So you could say no to a bag check and try to keep walking all you want, but that doesn’t mean you’re out free. They can use reasonable force to detain you from there. So you saying no to who you thought was an SA could have been an LP who could have grabbed your arm. Obviously good this didn’t happen, but please be aware of this. If they thought you took something with some amount of “reasonable” suspicion, which in and of itself could be the denial of a bag search, they can detain you.
So please, take this into consideration. An LP could forceablly search your bag all they want, but you really wouldn’t have much of a case if you tried to sue them. First, you’d have been caught lifting which wouldn’t help. Second, you’d have to prove there was some sort of damage to you. Slander or defamation requires something along the lines of screaming at you surrounded by people that you shoplifted when they know you didn’t or the like. You could also try invasion of privacy, but unless hey put on display your items and such then that wouldn’t work out.
Obviously in that situation walking can be your best bet, but please keep in mind that that isn’t a get out of jail free decision.
This is all for the USA, in a lot of other countries it’s a hell of a lot stricter. So yeah, please consider this
In order to legally search your bag stores have to visibly display signs or give something that communicates it across clearly. Stores like Costco wil obviously have it written into tthe contact but stores like Walmart where you go in as you please? They need a visible sign stating you consent to bag searches by entering the premise. You can find these signs at entrances, exits, and checkouts.
There is a difference between going through your personal bags and your bags from stores. They have a right to ask to see the contents of your bag but that’s it. The right to ask. They aren’t allowed to take your bag without your permission. If they do suspect you they’ll either tell you to leave the premises and not return or detain you and call the police. I never said they can’t detain you and there are laws allowing stores to detain but only for a reasonable amount of time. While you’re detained they cannot search you. There’s a difference between being detained and being searched.

Im the case that you are asked to search your bags politely decline. They do not have the right to search your personal belongings. In the case they pursue, state that it is within your right to decline and only a cop will be able to legally search you under reasonable suspicion. If they say they have the right, ask them where it explicitly states that when entering the store. If they show you a sign you’re screwed and have to show it legally, if they don’t the balls in your court. They may detain you and if you’re lucky the cops won’t show up and they have to release you. It’s a better wager than revealing the stolen items in your bag and having a definitive case.
I didn’t mean it to be a yeah fuck you you can’t do shit and walk away, just that it’s within your rights to refuse and you have a much higher chance of not being charged if they have no evidence. Of course this is why body concealing is best so you can flash your bag and show no stolen merch and they can’t search your persons. But in the case you do have something in your bag it’s best to exercise your right to refuse a search.
I don’t think a sign posted at the entrance to a store saying they have the right to check your bags means you can’t say no, but I don’t know much about US law.
