Exerpt: "In January 2025, Health Minister Tim Nicholls announced the ban on stage 1 puberty blockers and stage 2 hormone therapies for Queenslanders under 18 with gender dysphoria.
The directive was challenged by families and struck out by the Supreme Court in October. Just hours after the ruling, Nicholls used his ministerial powers to reinstate the ban.
QCAT’s ruling will allow for all young people diagnosed with gender dysphoria who had not started treatment before the 2025 ban to join the complaint.
The LGBTI Legal Service represented the original complainant and solicitor Emma Bastable said now, hundreds of trans young people and their families “will have the chance to have their discrimination claims heard”.
“This case is not limited to young people who were already on a treatment pathway, with the Tribunal finding that being denied the opportunity to be considered for treatment is enough,” Bastable said.
“The Tribunal has recognised that exclusion itself can cause harm, even before a young person reaches the point of treatment."
