The Limitations of Forensic Science
In a criminal court case, two things need to be demonstrated
1. Actus Reus - a guilty action
2. Mens Rea - a guilty mind
Forensic science is good at demonstrating Actus Reus, the physical evidence from the crime scene allows information on what has happened and who did it but forensic science can be limited in that it does not prove the intention. What about Mens Rea?
Say we have a body with bullet holes. We know someone was shot, maybe even who shot them based on fingerprints on and ownership of the gun. But how can we prove motive?
This was exactly the case when the former vice president of the USA, Dick Cheney, and his friend Mr Whittington went out hunting. Whittington was shot by Cheney, this is undisputed and undenied by Cheney. The question is why?
Forensic science proves it happened even without Cheney’s admittance. Fingerprints, footprints, ballistic evidence, timing, the list goes on.
But why did it happen? Cheney claims it was a mistake, the men were hunting, he heard a noise and shot completely unaware it was Whittington. No forensic evidence can dispute this. There is no evidence for Mens Rea.
