Actus Reus

Warning: allusions to noncon and trauma, some elements untagged.

He’s all dressed in black

And he’s drunk

Banging on your door as if he’s intent on knocking it down

You let him in because you know he will

He stumbled in and the empty flask bounces against the wall

He kicks the door shut as he plants a hand on the coat rack to steady himself

“What are you doing here?” you ask

Of course, he only ever came around for one thing

But you hoped after the tragedy that he might stay away

That the mourning might undercut his anger

“What?” he spits and his hand goes to your throat, “Why do i ever come around? You’re only good for one thing.”

“Really?” you huff

He staggers and his hand slips to your shoulder

“They’re dead,” he says in a small voice

You watch him cynically. He didn’t care so much when they were alive

“And you’re alone, like you deserve,” you shove him away and reach for the door, “go home and sober up.”

“No, I’m not alone,” he closes the door as you begin to open it, “you… you get that mouth ready.”

He grabs your chin and hooks his thumb over your bottom lip

“You’re disgusting,” you utter, “Andy, your family--”

“Like I don’t know!” he hollers and latches onto you

He spins and tosses you so that you sprawl against the long rug that stretches beside the stairs

You sit up shakily and he grasps your ankles, pulling you so that your back hits the floor

He drags you, the carpet rumpling beneath you

He slips you over and straddles you under him as he rips down your jeans

“Andy--” you slap the floor and claw at the wooden laminate

“Shut up, you bitch,” he snarls, “you know what happens if you scream. You don’t want everyone to know you’re a whore--”

“Stop, please, this isn’t-- you’re drunk--” you hiss as he hits the back of your head and your nose cracks against the floor, “ow.”

“There’s nothing left to keep me from you,” he snarls as he jolts your body, the denim town down to your ankles.

The Limitations of Forensic Science

In a criminal court case, two things need to be demonstrated

1. Actus Reus - a guilty action

2. Mens Rea - a guilty mind

Forensic science is good at demonstrating Actus Reus, the physical evidence from the crime scene allows information on what has happened and who did it but forensic science can be limited in that it does not prove the intention. What about Mens Rea?

Say we have a body with bullet holes. We know someone was shot, maybe even who shot them based on fingerprints on and ownership of the gun. But how can we prove motive?

This was exactly the case when the former vice president of the USA, Dick Cheney, and his friend Mr Whittington went out hunting. Whittington was shot by Cheney, this is undisputed and undenied by Cheney. The question is why?

Forensic science proves it happened even without Cheney’s admittance. Fingerprints, footprints, ballistic evidence, timing, the list goes on.

But why did it happen? Cheney claims it was a mistake, the men were hunting, he heard a noise and shot completely unaware it was Whittington. No forensic evidence can dispute this. There is no evidence for Mens Rea.
