Misyār Marriages [Where Women Give Up Some of their Islamic Rights]

Question: “What is your view O noble Shaykh concerning Misyār marriage (where a man has an Islāmic marriage contract with a woman, fulfilling the conditions of marriage, but the woman gives up some of her rights such as accommodation, maintenance, or the husband’s staying overnight with her), السؤال : ما رأيكم معالي الشيخ في زواج المسيار

And what is the Sharī'ah ruling concerning it?” وحكم الشريعة فيه ؟

Answer (Shaykh Sālih al-Fawzān, may Allāh preserve him): “We do not advise it, الجواب : لا ننصح به ،

Because it is not in line with the good interest of an Islāmic marriage. لأنه لا تترتب عليه مصالح الزواج الشرعي ،

Rather it is merely fulfilling the desires. وإنما هو مجرد قضاء شهوة ،

And he will not have authority over his wife, ولا يكون له سيطرة على زوجته ،

Snd she will not live with him in his home. ولا تسكن معه في بيته ،

And if they have children they will be far away from him and from his supervision. وإذا حصل أولاد يكونون بعيدين عنه وعن رقابته ،

Thus the intent behind marriage will not be achieved. فلا تحصل به مقاصد الزواج ،

Therefore we do not advise it.” فلا ننصح به .
