I currently work at a law firm and one of the associate attorneys wants to leave to start her own practice…and take me with her. I’m keen to go and we’re both very excited. My question is: what is a reasonable way to bill for the “start up” time I’ll spend helping her open her firm. Some sort of flat fee “bonus” once payroll is up and running? Set an hourly rate and track time? (I’d like to avoid being paid as an independent contractor to keep taxes easier later.) Any thoughts, suggestions, tips, hints, hilarious comments for this? Honestly, I'd bill her for an hourly rate. Unless she's offering you a salary from day one with the expectation that you'll put in full 8-9-hour work days, this seems the most equitable way to be paid for your time.
If she's a good boss, then payroll or at least invoicing will be the first thing she sets up. It's complex, so if she wants you to work for her... offer to do the research and legwork yourself! Either way, I do not recommend a handshake agreement on some hypothetical future compensation. Whatever you decide with her, get it in writing--something legally binding that you can use to ensure you're paid for your time.
