The United States Supreme Court has decided that it will look over the Voting Rights Act of 1965. The enforcement provision of the Act has been called constitutionally unnecessary  and just a mandate of the civil rights era which has passed. This provision, Section 5, gives the federal government the ability to oversee states and local areas to assure that there is no voter discrimination at play. It also ensures that  changes in voting laws on the state and local levels must be cleared by officials on the federal level before any enforcement. Many believe that it is an issue of the past that no longer needs to be in place. However, Congress extended the provision for 25 more years in 2006. Some states and localities have verbally protested the act and some have even filed a lawsuit, saying it gives the authorities in Washington too much monitoring capability over them. Some individuals have stated the equal access must still be monitoring in the election process so that it is inclusive to as many people possible. Nobody knows which way the Supreme Court will lean on section 5 of the Voting Rights Act of 1965, but we expect to find out early in 2013 as the justices take up this issue.
