When You Differ On A Matter, Take It Back To Allah And His Messenger
From what was narrated by al-Bukhārī: Huḏayl b. Shuraḥbīl narrated: Abū Mūsá (may Allah be pleased with him) was asked the (inheritance of) a daughter, a granddaughter and a sister. فَمِنْهَا مَا أَخْرَجَ الْبُخَارِيُّ عَنْ هُذَيْلِ بْنِ شُرَحْبِيلَ، قَالَ: سُئِلَ أَبُو مُوسَى الْأَشْعَرِيُّ عَنْ ابْنَةٍ، وَابْنَةِ ابْنٍ، وَأُخْتٍ، He responded: Half is for the daughter and half is for the sister. فَقَالَ: لِلْبِنْتِ النِّصْفُ، وَلِلْأُخْتِ النِّصْفُ، Ibn Masʿūd (may Allah be pleased with him) was asked (the same question) and was informed of the statement of Abū Mūsá (may Allah be pleased with him). وَأْتِ ابْنَ مَسْعُودٍ، فَسَيُتَابِعُنِي، فَسُئِلَ ابْنُ مَسْعُودٍ، وَأُخْبِرَ بِقَوْلِ أبي موسى، So he replied: “Then I have gone astray if that is the case and I am not from amongst those who are guided. فقال لقد ضَلَلْت إذًا، وَمَا أَنَا مِنْ الْمُهْتَدِينَ، I will judge regarding this matter with that which the Messenger of Allah ﷺ judged with. أَقْضِي فِيهَا بِمَا قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: Half is for the daughter. لِلِابْنَةِ النِّصْفُ، وَلِبِنْتِ الِابْنِ السُّدُسُ، تَكْمِلَةَ الثُّلُثَيْنِ، A sixth is for the granddaughter, completing two thirds. And what remains is for the sister.” وَمَا بَقِيَ فَلِلْأُخْتِ، We went to Abū Mūsá and informed him of the statement of Ibn Masʿūd (may Allah be pleased with him) and he responded: “Do not ask me (any more questions) as long as this scholar is amongst you.” فَأَتَيْنَا أَبَا مُوسَى، فَأَخْبَرْنَاهُ بِقَوْلِ ابْنِ مَسْعُودٍ، فَقَالَ: لَا تَسْأَلُونِي مَا دَامَ هَذَا الْحَبْرُ فِيكُمْ، انْتَهَى. al-Zaylaʿī, Naṣb al-Rāyah 4/178 الزيلعي، نصب الراية ٤/١٧٨ https://shamela.ws/book/11428/1744 @ilmtest [https://t.me/ilmtest]
