So....What irks me with the Star Wars Theory’s Fan Film copyright claim issue...
So what’s getting my goat about this whole situation is how poorly SWT has handle this. He claims he doesn’t want to be part of the toxic fanbase, but he likes to appeal to them for what I believe is for views. My proof of this can be seen when he puts all the blame of the monetization claim on his Vader Fan Film on Disney and gets his fanbase riled-up. He starts spewing anti-Disney crap on twitter and seems to start bandwagoning on the anti-Disney Star Wars. Now he seems to be back-peddling with explaining why he was in the wrong and trying to play the both sides. I believe he knows this isn’t Disney’s doing, but this situation has gained him more viewers from the Anti-Disney crowd
So before he started on his fan film he asked permission from Lucasfilm and want their rules/requirements were for fan films. So they got back to him and told him no monetization and no crowdfunding for it. There reason is with other’s intellectual properties you cannot make any kind of profit or financial earning even if it’s to fund your own fan project and even if not a cent goes to you personally it’s still not allowed under copyright. And that how fan works are allowed today. You can make them with your own cash but when you start taking in money for it, then it goes into legal jeopardy. So Star Wars Theory agreed, but even then I saw some of his actions could put him in legal peril. He still took crowd-funding for his own channel, which not only where he posted his fan film, but it’s hard to say if not a cent went into his fan project. Then there is the monetization of his Behind-The-Scenes and Making-Of videos of his fan film. Another gray area that could put him in trouble, BUT that isn’t what this claim on his film is about.
SWT hired someone to compose a cover theme of the Imperial March for the film and then he got a manual copyright claim that listed several companies their right to monetize the video. Now you see the Imperial March is technically owned/licensed by multiple companies. Disney’s music company is one of them since they bought the rights from Universal, but here’s the kicker. Warner Brothers Music Company’s (parent company is Access Industries) Warner Chappell also helped with license some of the themes of Star Wars. It was Warner Chappell who sent the claim. If Warner Chappell wants to receive anything from a claim they have to list and share with all the companies that own the rights to that piece as well. So to go and blame Disney for this whole debacle is very dumb of SWT. Thing is I think he knows its a third party doing this and still says Disney holds part of the blame. Now I don’t know if his reasoning is cause they are listed as one of the companies that own this material but just a tad bit of looking into this would show that it wasn’t Disney who sent this. Heck his last video on this showed he tried talking directly to Warner Chappell.
SWT should have done his research and see who owned all the rights to the intellectual property he was going to use in his fan film. Get the proper permission or just not use the ones he couldn’t get permission for. This has been a long issue in fan films and just the little bit of research would show that Warner Chappell has gone after many youtubers for using Star Wars music in their videos. It not just Star Wars… there’s video after video of them claiming on music they own the licensing for that others have in their videos. You know who use to own the rights to “Happy Birthday”, ding-ding it was Warner Chappell and they use to make $2 million a year just from that song before 2013. As of March 2016, the song was allowed into public domain thanks to a lawsuit.
Here’s a link to a documentary on the history of this case: https://www.theguardian.com/news/video/2016/jul/01/happy-birthday-song-campaign-song-jenn-nelson-warner-chappell-video
So yeah be careful when it comes to copyright and DO YOUR RESEARCH!
Hi! What do you think about Louis and his connection with Warner music? Could he be working with Sony and Warner at the same time?
Rozes tagged Warner/Chappell on her photo, not Warner Bros Records. They’re a publishing company not a record label, though both are owned by Warner Music Group. Both Rozes and Jesse Thomas have publishing deals with Warner/Chappell and they were in a writing session with Louis so that’s why she tagged them.
So I don’t think we should read anything into it with regards to Louis’ connection to Warner unless we hear something different.
