It’s not a secret that divorce among the over-50 crowd is on the rise.

If the Affordable Care Act works as intended, the law could prove to be a game-changer, by easing the financial burden of health insurance for divorced people who get dropped from their spouse’s medical plans.

Every year approximately 115,000 women no longer have health insurance as a result of divorce.

Generally people get dropped from their spouse’s plan, so the new legislation will help those with little or no coverage get the care they need to maintain a similar standard of living before the divorce.

Financial problems for divorcees over 50 years old may now be alleviated through Obamacare or the Affordable Care Act. Ex-spouses, left without health insurance after the divorce, many now have affordable options that may lessen the blow of divorce.

Grandparents Visitation RIghts

When the unfortunate happens and a couple files for divorce, it becomes much harder when child custody/support matter are involved. Some parents have a hard time coming to an agreement, and at times the judge will have the final say on who will hold primary custody and settling the child support as well.

Terminating Parental Rights to end Child Neglect/Abuse

There are so many children hurting from neglect and abuse brought by their own parents, those children have a right to have a safe environment, loving home, and guided to live respectably, learn right from wrong.

When that is not the case, and a child is born into a life where his/her parents are unwilling, or simply have no means to provide their child with such a home. Can I Keep My Home?

In a California divorce, assets and debts accrued during the marriage are divided equally. The most valuable martial asset is usually the home. The largest debt is usually the mortgage. Deciding who gets the house in a divorce is more complicated and filled with emotions than just agreeing on who wants it. However, like everything else, it’s up for negotiations. There is no rule that the spouse who has the children gets the house. The house is up for bargaining, just like all other aspects of the case. Ask yourself – Do you have the income to keep the house on your own? What about the mortgage payments and monthly utility bills? How about daily living expenses and the expense of raising your children? Even though you may receive child support and even spousal support, the amount may be far less than what you would need to maintain your home. In case you aren’t aware, couples can continue to own a home jointly for an extended period after the divorce. This is usually done to provide a stable environment for the children until they reach the age of 18. Children After A Divorce

The care of the children after a divorce is the most ongoing source of conflict for parents. Courts, most of the time, will honor a custody agreement reached by the parents. However, if they cannot come to an agreement, the court will request the parents to participate in a mandatory mediation session. If they still cannot agree on custody, the court will do so for them. There are several types of custody arrangements:

◾Physical custody – gives the parent or both parents the rights and responsibilities for the daily activities of their children. The children live with the parent or parents who is awarded physical custody. ◾Legal custody – gives the parent or both parents the rights and responsibilities to make major decisions regarding their children’s upbringing – including medical care, education, religion, and day-to-day activities. ◾Joint custody – Under California Family Code Sections 3080 through 3089, both parents can be awarded joint legal custody and joint physical custody. Joint custody allows both parents to share the responsibility for making major decisions. They must be able to work together. ◾Visitation – The most common schedule allows the non-custodial parent to see his or her children one night during the week, every other weekend, and part of the summer vacation. ◾Holidays and special dates usually alternate between the parents.
