there’s been some community talk about whether or not it’s appropriate to sell characters along with any commissioned art of those characters, here is my take:

FIRST OF ALL this hasn’t been a common topic in the WoW art community but it is absolutely common practice in other art communities. I’ve been seeing more MMO-centric adoptions and character sales lately, and in light of recent developments, I’ve updated my ToS.

GENERALLY I don’t care if people sell their own characters and bundle private commissions of those characters into the sale. Usually buying character art in a bundle means each individual piece is selling for less than what the owner originally paid for it, and I’m fine with that. 

HOWEVER, selling commissioned artwork bought from me for higher than my original price = making money directly off my work, and that violates my ToS.

From my ToS:

When you buy a commission from me, what you’re buying is a private commission intended for private use.  Private Use includes:  icons, profile images (such as for roleplaying), forum signatures, additions to personal galleries, printouts for personal use (such as a con badge), and other simple online musings.  Limited alterations of the artwork, such as cropping or adding text, are permitted as long as it’s for your personal use.   

You may NOT use or alter the commissioned artwork you receive from me for the purpose of monetary gain, such as reselling the art for a higher price, selling prints of it, selling it on t-shirts, selling it on items over Etsy, etc.  You may NOT repurpose the artwork as a logo or for any other form of commercial advertisement unless previously negotiated with me.  

If you later choose to sell your character and the sale includes private commissions originally bought from me, please first CONTACT ME about it, cuz the new owner needs to know about my ToS and must agree to it prior to the sale.  

By selling your character, your usage rights to the commissioned work and all commercial restrictions simply transfer to the new owner, which means they can now use the artwork for their own limited personal use, as listed above. The new owner may NOT use my artwork for any commercial or monetary gains even if they did not buy the commission directly from me.

If the buyer does not agree to my terms, please remove my artwork from the bundle you’re selling!

Finally, by selling off your character you forfeit all private usage rights to any artwork commissioned from me that was included in the sale, since neither the art nor the character belong to you anymore. This is to prevent confusion over who owns the character and who is allowed to post the art.

If anyone approaches you over tumblr (or anywhere) claiming they’re me OR claiming they’re contacting you on my behalf offering cheap commissions, it’s not me.  I am NOT offering commissions!  Please be careful!!

That being said, this month I only took commissions from my patrons over on patreon.  This is the first month I’ve had a patreon open and it’s been really great!  I’m not sure if I’ll make commission availability patreon-exclusive or not, the decision will likely change month-to-month depending on what I have the energy for, but March was patrons only.
