Мосгорсуд отказался признать незаконным обыск у гей-пары усыновителей
1 февраля Мосгорсуд отклонил апелляционную жалобу на постановление Басманного районного суда Москвы, отказавшегося признать незаконным обыск в квартире у Андрея Ваганова и Евгения Ерофеева – гей-пары москвичей, усыновившей двух детей и подвергшихся преследованию со стороны Следственного Комитета РФ. Ранее ведомство возбудило дело против столичного органа опеки по подозрению в ненадлежащем надзоре за проживанием несовершеннолетних детей у двух пап.
В ходе судебного заседания, на котором интересы заявителей представляли адвокаты, привлеченные ЛГБТ-инициативными группами «Выход» и «Стимул», всплыло постановление Басманного суда от 22 июля 2019 года о законности проведенного обыска. Основанием для него, как следует из документа, стало подозрение в совершении преступления в отношении усыновленных детей, а также предположение следствия о том, что в жилище Ваганова могли находиться «предметы и документы, имеющие значение для уголовного дела».

Moscow City Court refused to recognize illegal the search of a gay couple of adoptive parents
On February 1, the Moscow City Court rejected an appeal against the decision of the Basmanny District Court of Moscow, which refused to recognize the search in the apartment of Andrei Vaganov and Yevgeny Erofeev, a gay couple of Muscovites who adopted two children and were persecuted by the Investigative Committee of the Russian Federation, as illegal. Earlier, the department opened a case against the metropolitan guardianship authority on suspicion of improper supervision over the residence of minor children with two dads.
During the court hearing, at which the applicants were represented by lawyers recruited by the LGBT initiative groups Vykhod and Stimul, a decision of the Basmanny Court of 22 July 2019 surfaced on the legality of the search. The basis for it, as follows from the document, was the suspicion of a crime against the adopted children, as well as the investigation's assumption that “items and documents relevant to the criminal case” could have been in Vaganov's home.
In these circumstances, the gay couple decided not to return home from vacation and applied for political asylum in the United States. Now the lawyers handling this case will discuss further strategies for challenging the illegality of the search.
