If Betsy Devos is appointed as our Secretary of Education sheâll be charged with protecting the most marginalized students in our country.
All children, even the poor Black, Latinx, and Native ones, have the right to a good public education.
Sheâll create a system of for-profit schools which will filter our children into the prison system. School-to-prison pipeline targets poor kids, disabled kids, mentally ill kids, Black kids and Latino kids⌠some of the most vulnerable kids in our society.
We already have schools largely segregated by class and color. If she is allowed to created for-profit charter schools she will make that much worse. The school-to-prison pipeline is even worse in for-profit schools than public ones.
Devos is a billionaire who doesnât understand what most Americans experience. Sheâs invested in many for-profit schools from early education to college. If sheâs allowed to take over our education system she will destroy what little progress we have made toward creating a truly equitable school system.
Betsy Devos couldnât even say during her confirmation that we shouldnât have gun-free schools (in case of grizzlies lmao!) despite all who have lost their lives in schools due to gun violence.

Physical and psychological. They are spreading terror. Tonight, the 8th of november, we took streets in Mexico City and after we walked peacefully, a strange and anarchist group with masked faces put the main entrance of âPalacio Nacionalâ on fire. They didnât came with us. We were walking in peace. Yelling, yes. A lot. But in peace. We are fighting against violence, so it is really, really stupid to claim for peace, with actions like these. This is not new in Mexico. The government always use these payed groups of people to criminalise any social movement. But we are possibly heading to a new era in our country. We are tired of corruption. We are tired of cold assassination. We are tired of the criminals who can walk in peace, and we are tired that both police and military forces protect them. We are so alone right now. We are so unprotected right now. We are not scared. We are terrorised. We need you to focus your attention for the next few days, so they donât dissappear and kill more of our young people. Government are killing people just because they can, and no one can stop them. We have no weapons, and we donât want some. We want to make a change after 70 years of corrupcy. They have took everything. They took our faith, our hope, our jobs, our dreams. They are destroying us. My country is one of the most beautiful and interesting countries in the world, and now foreign people are even recommended not to visit this beautiful land because of insecurity. I get where this is coming from, but when I say we set the country back 50 years, Iâm speaking from an organizing and lawyering perspective.Â
The incremental legal changes that folks have been fighting to make since the Civil Rights Act passed are about to get systematically undone. Trump has promised to undo every single one of President Obamaâs executive orders. Heâs going to attempt to stack the Supreme Court with alt-right Justices (potentially 3-4 new Justices), all of whom will be young and remain on the court for 30-50 years, shaping law for the rest of most of our lives. Thatâs the rest of my life as a lawyer now spent dealing with shitty precedent and being forced to craft even shittier legal arguments to appeal to the new alt-right Justices in a vain attempt to preserve our rights only for it to ultimately be ignored and shot down. The amicus brief on Fisher II isnât even cold yet, but you can bet conservative impact litigators everywhere are readying anti-Affirmative Action cases at this very moment. Meanwhile, to mount a challenge to that, weâre going to have to toss all of the carefully crafted & tailored legal argumentation folks spent years on just to sway Justice Kennedy and go in essentially blind to what arguments might appeal to the new extremely conservative Justices. Honestly, all the folks who worked tirelessly to save Affirmative Action, bring us marriage equality, & are fighting to preserve our rights in less well-known cases, were royally fucked by this election result. We basically have to reinvent the wheel for progressive impact litigation lawyering.Â
All of this dovetails into âorganizing.â People keep saying that âwe just need to come togetherâ and ânow is the time to organizeâ without defining what that is or what it looks like in Trumpâs America. Whenever folks talked about organizing before it was mostly about changing policies, moving lawmakers & politicians, & changing laws. WellâŚhow are we supposed to change policies, move lawmakers, or change laws, when all the power players are now extremely conservative Republicans with little to no politicalopposition & thus no incentive to listen to the concerns of âlosers?â We just elected the people whom we knew didnât care at all about our issues. These folks think BLM is a terrorist organization, they think trans folks should be banned from public bathrooms, they think we should electrocute the gay away, they think all Muslims & anyone who âlooks like a Muslimâ is a terrorist, they think all Brown folks are âforeignâ and need to be deported. These are not reasonable people. They are not moved by our protests. And they have the power and the tools to make what they believe in policy and to make it legal & constitutional.Â
When I say weâve regressed 50 years, itâs not because I was laboring under the delusion that white people had somehow bettered themselves. Iâve never been that naive. When I say weâve regressed 50 years, I mean that weâve handed over to the enemy all the tools weâve scraped and fought for & forged with our own blood, sweat, tears, and lives. There is no more struggling for progress. Weâre struggling for basic survival now, to hold on while so many of the rights we managed to win are stripped from us. When Trump said he was gonna âmake America great again,â taking us back to the 50s is what he had in mind. And from a civil rights, constitutional, & policy perspective, thatâs exactly where heâs going to take us. Â

I saw a white gay man actually argue today that there was no way Trump would be able to strip marriage equality, and I just boggled at the peak privilege ignorance of that attitude. Iâm basically going into the next four years hoping I donât come out having to use a colored only bathroom, with my OWN marriage put in legal limbo because miscegenation was only fully legalized in 1967.
It hasnât even been 24 hours since Trump was elected.
