A German regional court has ruled that Google is directly liable for false claims in its AI-generated search overviews. In this case, Google's AI had wrongly linked two publishers to scams and shady business practices. The court treated the AI overviews as Google's own content and rejected Google's argument that users were responsible for fact-checking the results themselves.

This is fascinating because due to copyright, generative AI engines often want to argue that they are not violating copyright because they are creating something new from the training data. But creating something new means being responsible for its accuracy and any negative impacts. Canât have it both ways.
It's well established algorithmically generated works (technically, anything not made by humans) can't be copyrighted, but that's really a separate discussion from publishing responsibilities. If a newspaper prints something without checking if it's true they're liable for spreading misinformation which, you have to judge in each case, can be very bad depending on how important the facts are and how many people the paper confuses; the same laws apply if Google produces search results that tell 50 million people asbestos is good for your health.
It seems Google's best defense is that you're not supposed to believe what they tell you, much like Fox News claiming to produce entertainment rather than news, but that perversion of freedom of speech legalizing disinformation under the disguise of "artistic work" may only be possible in the US.
Anyway the point isn't if it's creative to have a computer make something up rather than making it up yourself, but if a search engine can function and be advertised as a search engine when it's making counter-factual stuff up.
