Prevent Creative Piggybacking
As many of you know, the post regarding tumblr's TOS changes has been under fire by skeptics. What they fail to realize is that ownership of content does not prevent a company from making aggressive and harmful marketing moves to exploit said content. Let us get some things straight:
These aren't attempts to incite fear. Over 30% of our staff actually have law degrees and analyzed those terms and conditions with the utmost scrutiny. The new TOS look quite run of the mill. That's the point. We don't bother posting warnings about other media hosting sites such as Youtube, Deviantart, or reddit because their terms of service make it abundantly clear that they can take advantage of your creations once you check "agree". Tumblr's wording is much more discrete on the matter which is why we brought attention to it. If you're still skeptical I suggest you re-read the TOS and look for ways that they could be exploited by the company. Bonus points if you find all three.
This is what is called "creative piggybacking". It's when a company or service makes the users feel like they're in control of their content and creation, but ultimately use them for profit. It's a problem because when they find an idea or creation that is quite good, clever, or well made, they will jump in and pressure the creator to give up control and rights in exchange for monetary incentives. The company never technically "owns" any of it. They don't have to own it to exploit it for profit. That is the major point.
In addition; this happened shortly after Yahoo bought out tumblr and as a response to my post, the TOS wording was amended to say that tumblr users retain ownership of their content. Which, the law majors among you probably know, is a simple attempt to appease the users and make them more open to manipulation. Simply having ownership does not prevent a hosting service from making money off of your media. And now with the new changes to the layout in order to bolster profits (working towards becoming a video themed site for monetized ad advantages) they want to take "partial" ownership of the content posted herein so that they have no legal trouble monetizing the future videos by selling ad space, which they can do as a hosting service. We made this announcement many months ago, and now the evidence is more apparent than ever. Protect your content, and boycott creative piggybacking.
