California has strict laws on how a three day notice must be completed. If there are any errors in the way the notice is completed or served, the landlord could have an eviction case dismissed, or thrown out, of court.
A common mistake is an “overstated” notice. This means that the 3 day notice to pay rent or quit has an amount that is higher than what the actual rent due is. If this happens, then a tenant can ask to have the case dismissed simply on this basis.
