United States http://current.com/1nv2ckc Eleven prominent law professors and fourteen renowned organic, Biodynamic®, food safety and consumer non-profit organizations have filed separate briefs with the Court of Appeals for the Federal Circuit arguing farmers have the right to protect themselves from being accused of patent infringement by agricultural giant Monsanto. The brief by the law professors and the brief by the non-profit organizations were filed in support of the seventy-five family farmers, seed businesses, and agricultural organizations representing over 300,000 individuals and 4,500 farms that last year brought a protective legal action seeking a ruling that Monsanto could never sue them for patent infringement if they became contaminated by Monsantoâs genetically modified seed. France http://ecowatch.org/2012/french-court-finds-monsanto-guilty-of-pesticide-poisoning/ A French court has found U.S. chemical giant Monsanto Co. guilty of pesticide poisoning in the case of a French farmer who became ill after exposure to one of the companyâs herbicides, according to Reuters. The case is significant in that it sets precedent for other cases alleging pesticide poisoning or negligence in reporting of potential effects on human health resulting from pesticides. The court has said it will seek an expert opinion regarding the farmerâs losses in order to determine the appropriate amount of damages he should be rewarded. The case stems from an incident in which the farmer, Paul Francois, inadvertently inhaled Monsantoâs Lasso pesticide when cleaning his sprayer tank on his farm in southern France in 2004. He then began experiencing memory loss, headaches, and stammering, among other neurological problems. This led to his decision to file suit against Monsanto, asserting that the company did not provide adequate warnings on the product label that would indicate these symptoms could result from exposure. The court agreed with Mr. Francois, stating that, âMonsanto is responsible for Paul Francoisâs suffering after he inhaled the Lasso product ⦠and must entirely compensate him,â according to Agence France-Presse (AFP). India http://www.naturalnews.com/033714_biopiracy_Monsanto.htmlIndia files biopiracy lawsuit against Monsanto, says biotech giant is stealing nature for corporate gain Representing one of the most agriculturally nio-diverse nations in the wrold, Indai has become a primary target for tiotechnology companies like MOnsanto and Cargill to spread their genetically[modified crops into new markets.  However, a recent France 24 report explainsts that the Indian government has decided to take an offensive approach against this attempted agricultural toakeover by suing Monsanto for âbiopriacâ accusing the company of stealing Indiaâs indigenous plants in order to re-engineer them into patented varieties. Brazil http://www.qwmagazine.com/2012/06/15/brazilian-farmers-win-2-billion-judgment-against-monsanto-2/ In April this year, a judge in the southern Brazilian state of Rio Grande do Sul, ruled in favor of the farmers and ordered Monsanto to return royalties paid since 2004 or a minimum of $2 billion. The ruling said that the business practices of seed multinational Monsanto violate the rules of the Brazilian Cultivars Act (No. 9.456/97). Monsanto has appealed against the order and a federal court ruling on the case is now expected by 2014.
This is a brief article, that includes links, which describe several different lawsuits against the corporation (there should perhaps be a new phrase to describe what these folks have become) Monsanto. This article includes a description of the failed suit of American farmers who had their property stolen, as well as a successful suit against Monsanto from a French farmer who suffered brain injuries due to proximity of a specific chemical produced by the company.
