I wish so many in this community didn’t outright glaze Judge Garnett. Just because she’s been slightly less awful than that bald fuck Carro, doesn’t mean she’s been good or even fair to Luigi. She didn’t rule in favor of any of the defense’s motions regarding pre trial publicity, allowed the backpack to be admitted into evidence, she’s deferring to the state now to ensure that the NY double jeopardy law isn’t triggered. She is simply awful.

Yeah, don't wanna repeat myself, I already wrote some things on this topic here, but now that we have some of her orders to analyze her decision making and thinking patterns, it is clear that she is biased - the way she was excusing LE and noting her distaste for having to make a decision favorable to defense (dismissing counts 3&4) made it very apparent that she's leaning pro-prosecution (but that's how the whole legal system is). :\ I'm not saying this because she didn't rule in favor of defense, but bc, as a scientist, I know how bias works very well, and it's always very disappointing to see that in the "Justice" system the standards to prevent bias are so so much lower. Most of the time the judges rule based on Vibes™ really. While someone's life is on the line.. Wish we had more judges who came from academic &defense fields.

To be fair on her though, defense was the one who asked to delay the federal trial - allowing for state trial to proceed first. Something I'm still unsure about, bc when Carro asked defense to do that, KFA said it that would be "legal malpractice" (true, if you're a good lawyer).

So, I'm not sure why defense changed their mind. Maybe they're focusing on the appeals. 🤔 But not much Garnett could've done after that, unless she was willing to act as petty as Carro.

Defense’s motions regarding pre trial publicity were handled kind poorly, I agree. She denied them as moot because they "primarily relate to or arise out of the capital-eligible character of Count Three" which was dismissed. But that's not really the case, while one of the reliefs defense asked for was dismissal of DP, they also asked to dismiss the whole indictment because of the prejudice caused by all this publicity. Feds took so long to indict him, one could argue that Bondi's statements helped with that - whether there was a DP on the line or not - because she marked him as already guilty. Though, of course, she thinks questionnaires and voir dire is gonna remedy all that. 🙄 It sets such a bad precedent for allowing prejudicial pre-trial publicity, tho.

She also let the prosecutor walk all over her with ignoring her order about Local Rule 23.1.

So yeah, glazing her is unwarranted, she's not fair. Carro's been atrocious, so it may look like she's doing well,but it's the bare minimum.
