So a little while back, @staying-elive wondered about Shangqi's immigration status, given how he did technically show up in the states with no documentation. So I did some research by asking my mom, who worked in immigration law for decades before she retired because I figured this question would be right up her alley.

And it was! So here's the rundown she gave me of what Shangqi probably did back when he decided to stay in San Francisco:

First off, since he was fourteen, he wouldn't be taking care of this all by himself. He'd need to be assigned a guardian which could just be the state. Here's Shangqi's situation; he's a minor with no documentation who can't go home because it is unsafe (because of violence/abuse/whatever he'd divulge without explaining the whole Ten Rings + thousand year old dad situation). That would make him applicable for the special immigrant juvenile status.

He'd need to go to juvenile court, where the judge would get him to fill out an I-360 form. Then he would apply for residency and a work permit. And yes I was like ?! work permit for a minor but apparently that's just what you fill out regardless if you want to do stuff like get a job, ID, driver's license etc.

So this is where things get a little sticky. When he was applying for residency status his immigration lawyer would ask him a regular series of questions to see if he's gone to jail or committed any crimes. Apparently when it comes to the special immigrant juvenile status they're pretty lenient so like most crimes even aren't that big of a deal. But! Violent felonies like, say, murder would be a huge red flag. Since Shangqi didn't even tell Katy about the person he killed when he got to the states, I doubt he was honest with his lawyer at this point either.

So my best guess is that Shangqi probably hid that fact from his lawyer while applying for his residency status. Put a pin in that!

Once he got residency status, he had five years after which he could apply for citizenship. Which, given that he presumably has a drivers license and passport since he drove a car and flew internationally in his movie, he most likely did. Applying for citizenship would require an N-400 and a citizenship test (that's the one where you get tested on your English and civics knowledge).

Timeline wise that probably happened when he was about 19, so just out of high school. So by the events of the movie, and in all the other movies he'll hopefully be in, Shangqi is officially a naturalized US citizen.

Back to the whole lying during his residency application issue, because of course it seems like it could go badly if anyone found out he murdered someone. Apparently he wouldn't be instantly deported, he would just need to get a immigration lawyer and fill out an I-601 which is an application for waiver of grounds of inadmissibility. Basically explaining that the grounds for inadmissibility (him initially lying about committing a violent felony during his initial residency application) don't apply to him.

Why wouldn't it apply? Because he (and his lawyer) could argue for extreme hardship. Basically yes, he lied, but it was because he was an abused traumatized child who was sent on a mission to assassinate the man who helped kill his mom. By his father, who was a thousand years old and ran a secret organization that influenced the course of history that Shangqi was trying to escape from. My mom was of the opinion that a good immigration lawyer could swing that. Also Shangqi would probably have to write a really heartfelt letter to the judge about how bad he feels regarding the whole situation.

I imagine that this all would be a huge headache for Sam though. Imagine having to suddenly make sure one of your Avengers doesn't get deported.

Also this whole process, which would have happened some time in the twenty tens, is way way harder now thanks to new immigration policies introduced by the Trump administration. Which, y'know, sucks. Fuck that guy and everyone who voted for him!

So I had not watched the doomsday trailer before seeing the preview before Spiderman and... okay fine, I do want to watch it. XMEN?! SHANG-CHI?! THERE WERE OTHER PEOPLE I WAS EXCITED ABOUT BUT I FORGOT WHO THEY WERE BUT ALSO I THINK I SAW SAM AND BUCKY STANDING NEXT TO EACH OTHER AND THAT MATTERS TO ME

We’re getting another Shang Chi movie?!? And it’s going to involve the tournament between the Heavenly Cities! Does that mean my dream of Shang Chi fighting alongside Danny Rand on the big screen may finally come true? We already know Iron Fist is returning for the next season of Daredevil too. Please. I just need this and maybe a Heroes for Hire series.
