I have a question when you said they could not fire her because of HIPPA, that does not seem right because HIPAA doesn't stop someone from being fired for attacking a coworker with a knife; in fact, it allows disclosure of health info to prevent a "serious and imminent threat," and workplace violence is grounds for firing, regardless of HIPAA, because it violates safety, policy, and potentially the law, with HIPAA only managing health data, not the violent act itself. An attacker faces termination for the assault, while HIPAA protects the injured, allows info sharing to stop harm, and punishes data breaches, not physical attacks. Let me just note that I took this directly from HIPAA because what you are experiencing does not sound right. Do you at least have a restraining order in place? I personally would not work there anymore, it seems unjust. Hope things get better.
Oh I absolutely know that what HR told me is completely insane, I do not have a restraining order (partially because HR told me I didnât have grounds for one!) but we have a new supervisor who was seemingly flabbergasted by how the situation was handled and he encouraged me to pursue a restraining order. So we shall see
