The Hind Rajab Foundation (HRF) has filed a complaint with the Indian Ministry of Home Affairs, Bureau of Immigration and police seeking the arrest of Eitan Gilboa, an Israeli national who is currently holidaying in Himachal Pradesh. Gilboa, the HRF has said, is a reservist in the Israeli army and has been directly involved in bombings and large-scale demolitions of residential buildings in Palestine, which constitute war crimes under the Geneva Conventions Act, 1960.

In a press release, HRF has said that their complaint details several instances where Gilboa had been involved in the destruction of civilian infrastructure in 2024, across Khan Younis, Rafah and Gaza. On the incident in Khan Younis, in January 2024, the HRF says:

HRF also says it has videos that Gilboa himself has filmed, where he is seen ordering, carrying out and celebrating the destruction of civilian infrastructure. These videos were reportedly shared by Gilboa’s family on social media.

Based on the evidence provided, the HRF has asked the Indian police to arrest Gilboa under Section 35(1)(c) of the BNSS read with Section 3 and Section 4 of the Geneva Conventions Act, 1960. If an arrest is not possible, they ask that the home ministry and immigration bureau remove Gilboa from Indian territories.

On why it has urged India to act, the HRF says, “These acts violate the Fourth Geneva Convention, ratified by India. As a signatory to the convention, India is legally obligated under Article 146 of the Geneva Conventions to search for and prosecute individuals alleged to have committed grave breaches, regardless of nationality. Furthermore, the presence of Gilboa in India contradicts Article 51(c) of the Indian Constitution, which directs the State to foster respect for international law.”

Afreen Fatima is an Indian-Muslim activist.

In 2022, after protests broke out in India, authorities gave her family a 1 day warning before they bulldozed her family home. 

Why? 

Her father was accused of organizing protests against anti-Muslim hate speech in India.

No due process. 

No time to respond before the house was reduced to rubble the next day.

For Afreen and her family, this was a violation of their rights.

For the ruling Bharatiya Janata Party (BJP), this was “bulldozer justice”: where Muslim homes, businesses, schools, and neighbourhoods are demolished as a form of collective punishment to deter dissent, under the guise of law and order.

◼️The report said: “Violations consisted of rape, including with objects, gang rape, attempted rape, physical violence to the genitals, instances of targeted shooting of the genitals, touching of breasts and genitals, strip and cavity searches conducted without apparent security justification, ⁠forced nudity and threats of rape”.

◼️“Rape and gang rape, in some cases repeated, were perpetrated against nine victims, the majority from Gaza,” the report noted.

◼️The perpetrators were identified as members of Israeli armed and security forces, with abuses carried out during detention, interrogation and across multiple facilities.

◼️The report makes clear that Palestinian civilians – including journalists and human rights defenders – were among those subjected to these assaults. Some victims were filmed or photographed, including in one case of rape.

◼️Women faced threats of rape, forced nudity, unwanted touching and degrading strip searches.

◼️Men and boys were subjected to rape, attempted rape and direct violence targeting their genitals.

◼️At least five male victims suffered severe rectal bleeding or swelling lasting days or even weeks.
