So my co-worker and I reported our senior manager a month ago, and we just found out today that a week after we reported him, he posted our jobs online to replace us. Our direct manager had no idea, and it wasn't even posted on our company's website, only a select few hiring sites, which makes me think he probably also did it behind the backs of his managers.
If I do nothing, I lose my job. If I report it to HR (people are loving giving me horror stories rn about HRs not protecting employees who report things), I could also potentially lose my job. Obviously, I have to go down fighting, so I'm choosing the latter. I've already looked into my rights and reached out to my state's department of labor for support dealing with this retaliation, and have already sent all of the current proof I have to my personal email address. I'll also be recording any convos about this going forward, which is within my state's laws that I can record any conversation I take part in.
I know my coworker and I have support from others in regards to this, but idk if it will be enough. There's two of us fighting, but idk if it will be enough. There's been other reports against this senior manager over the years, the most recent being only 2 weeks ago by someone who doesn't even work under him, but idk if it will be enough. We do have proof that would support us in claiming this is retaliation, but idk if it will be enough. I have no idea which is the more realistic scenario: HR sides with the little guy on their injustice or HR sides with the big guy who has continuously caused issues. Companies always seem to have these strong policies in place, but I've never actually heard about any of them following those policies when it comes time to do so. Maybe people just aren't bragging about their success stories as much as they're complaining about their horror stories...I hope....
I hate that I have to go through this at a time where I am really starting to feel okay and safe financially, just to have a petty ass man try to take that all away from me because I had the nerve to report him for misconduct and mistreatment, which is well within my rights to do so. And in the time since then, I can even add on harassment and duress! There has been so much bullshit from this guy that we've had to deal with, and it has been adding on even more stress to an already stressful workload. I wouldn't put it past any corporation to protect a man who feels like he can do whatever he wants - especially a man who holds a higher position within that company - but I'd also hope that with such a bad track record they'd eventually be willing to let that person go if it could create big problems for them (like lawsuits from not one but two employees who had to deal with retaliation, which is illegal 🤗).
This man has been a bully to other workers since his first day of employment and people have allowed it to continue for years. I am not tolerating it. I will go down kicking and screaming and biting and scratching if it means taking him down with me. I will work 3 jobs if it means I will be able to afford a lawyer to sue for this, if needed. I have worked so hard for this place for years. I've been overworked and underpaid, working in a role that should actually be done by two people, not one, as they are two separate positions, making at a minimum 10k more than I do. At one point, I was doing three roles in one, and this is what happens?!? Seriously, fuck corporate america. And fuck this guy. People mistakingly think I am an easy target because I am quiet and nice, as if both those things somehow equate to weak. But they're wrong. I will defend myself, using whatever means necessary. Throw a punch and I will fight back. Scrappy punches still cause damage if enough hits make contact. I just have to stay determined and be confident that I can win not only the battle, but the war. Many of my comrades have unfortunately fallen, but I hope that I can do us all justice by taking out the man who has not only slain them, but also started this war in the first place.
